HomeMy WebLinkAboutOrdinances Book 13, Page 460, No Ordinance Number4.60 / p AN ORDINANCE AUTHORIZING THE CITY OF PADUCAH TO ENTER INTO AN AP-MTTDED SUPPLED-1ENTAL AGREEMENT WITH THE KENTUCKY UTILITIES - COMPANY SO AS TO FURNISH INCREASED LIGHTING ON THE STREETS OF THE CITY OF PADUCAH 'WHEREAS the City of Paducah entered into an agreement with Kentucky Utilities Company under date of August 30, 1940, by the terms of which Kentucky Utilities Company was to furnish certain White -way suspension and other lights on the streets of the city, and said agreement provided for certain payments therefor by the City, and WHEREAS said agreement was subsequently amended by a Supplemental Agreement dated November 25, 1911 and by Supplemental Agreement dated January _ 1952 changing certain provisions in Article I of the priginal agreement, and I'RIEREAS it is now desired to make additional changes in said lighting contract which will result in increased payment by the City. I<09 THEREFORE, BE IT ORDAINED BY THE BOARD OF CORu•ffSSIONERS OF THE CITY OF PADUCAH, I'ENTUCKY: SECTION 1. That the City of Paducah contract with Kentucky Utilities Company for increased lighting on the streets in the city and that said contract be in words and figures as follows: "THIS AMENDED SUPPLEMENT AGREF2-ENT, made and entered into on this the day of 1955, by and between Kentucky Utilities Company, hereinafter called the ?Company?, and the City of Paducah, Kentucky, hereinafter called the 'Customer?. W I T N E S S E T H: "THAT WHEREAS, the parties hereto entered onto a contract on August 30, 1940 and Article I as amended by the Supplemental Agreement dated November 25, 1941, and further amended by Supplemental Agreement dated January _ 1952, contained the following provisions: ARTICLE I "The Company agrees that it will furnish, erect, maintain, clean, repair and operate a street lighting system in the City of Paducah, Kentucky, and the Customer agrees that it will receive and pay for such street lighting service in accordance with the terms set out herein. "The Minimum street lighting service to be furnished by the Company, and received and paid for by the Customer, shall consist of the following number, size and type of street lights: 1F61 58 - 10000 lumen White Uay lights 7$ - 6000 lumen Miite Flay lights 96 - 4000 lumen White Way lights 231 - 2500 lumen Overhead Suspension Street Lights 324 - 4000 lumen Overhead Suspension Street Lights 50 - 1000 lumen Alley and Viaduct lights 837 - Total (As per Franchise) 6 Cast Iron light posts on Fourth Street Bridge 100 watt lamps each 4 Cast Iron light losts on Sixth Street Bridge 100 watt lamps each All of the above lights to burn every night from duck to day -light. All the above equipment, including electric circuits, poles, fixtures, time -snitch, lamp and lamp replacements, etc., will be furnished, maintained and operated by the Company for the sum of +;}i7,360.00 per year, which amount shall be payable in equal monthly installments of :;;1 446.67 each and these payments will be made by the Customer to the Company on or before the 20th day of each month following the month in which service is rendered." AND ClI-1 REAS, it is; the desire of the parties hereto to amend said contract; NOW THEREFORE the premises considered, the pasties hereto agree that Article I of the aforesaid contract of August 30, 1940 and amended by Supplemental Agreements of November 25, 1941 and January _ 1952, be, and the same is hereby amended to read as -Follows: "ARTICLE I "The Company agrees that it will furnish, erect, maintain, clean, repair and operate a street lighting system in the City of Paducah, Kentucky, and the Customer agrees that it will receive and pay for such street lighting service in accordance with the terms set out herein. "The minimum street lighting service to be furnished by the Company and received and paid for by the Customer shall consist of the following number, size and typm of street lights: 58 - 20000 lumen mercury 161hite Way lights 78 - 6000 lumen White Way lights 96 - 4000 lumen 1'dhite Way lights 231 - 2500 lumen Overhead Suspension Street Lights 324 - 4000 lumen Overhead Suspension Street Lights 50_ 1000 lumen Alley and Viaduct lights 837 - Total (As per Franchise) All of the above lights to burn every night from dusk to day -light. All the above equipment, including electric circuits, poles, fixtures, time -switch, lamp and lamp replacements, etc., will be furnished maintained and operated by the Company for the sum of til$ 2$9.00 per year, which amount shall be payable in equal monthiy installments of ;;1,524.00 each and these payments will be made by the Custoner to the Company on or before the 20th day of each month following the month in which service is rendered". "All of the other terms, conditions and stipulations contained in said Street Lighting Contract dated August 30, 1940 shall remain and continue in full force and effect. 462 "IN TESTIAiONY WHEREOF, the parties have caused this contract to be executed by their duly authorized officers, this the day and year first above i^witten. It is further arovided that the F'ayor of tlye City of Paducah will execute the contract referred to in Section 1 herein and same shall be attested by the City Clerk, and when so executed by the City of Paducah and by the Kentucky Utilities Company shall be in full force and effect from the date thereof. SECTION 3.
