AN ORDINANCE PROVIDING FOR AND AUTHORIZING THE EMPLOYMENT
OF BLACK & VEATCH, CONSULTING ENGINEERS, IN CONNECTION WITH THE
SEWAGE DISPOSAL PLANT, PUtiIPING STATIONS, ASSOCIATED EQUIP14ENT
AND NECESSARY SEWERS IN THE CITY OF PADUCAH, KENTUCKY ARID DECLARING

BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY
OF PADUCAH, KENTUCKY:
SECTION 1. That the firm of Black & Veatch, Consulting
Engineers of Kansas City, Missouri, shall be employed in connection
with the sewage disposal plant, pumping stations, associated equipment
and necessary sewers in the City of Paducah, Kentucky, shich project
has been recently approved by the voters of the City, and that the
Mayor be, and he is hereby, authorized to execute and deliver on
behalf of the City of Paducah, Kentucky, an agreement and contract
of employment of the said firm in words and figures as follows:
"THIS CONTRACT, made and executed in triplicate this day of
1954, by and between the City of Paducah, Kentucky,
a municipal corporation hereinafter called the City, party of the first
part, and Black & Veatch, Consulting Engineers, of Kansas City, Missouri,
hereinafter called the Engineers, parties of the second part,
WITNESSETH: That in consideration of the mutual covenants herein con-
tained, the City hereby agrees to employ the Engineers to perforry the
services hereinafter outlined and agrees to pay them for such services
according to the schedule of fees herein contained.
Section A: The services which the Engineers agree to perform are:
1. To review the basis of design of the sewage improvements
prepared for the City in 1947 in order to determine any
changes or modifications necessary to care for the in-
creased residential load, the industrial waste development
and other changes such as more widespread use of garbage
grinders in order that proper and adequate facilities may
be provided to meet the requirements of the Ohio River
Valley Sanitary Commission and the Kentucky State Health
Department and Stream Pollution authorities.
2. To prepare a study of financing so that in the event the
City desires to levy sewer service charges to cover the
interest and sinking fund requirements of the bond issue
just voted or to provide any additional funds needed for
financing the present program, the City will have a guide
to the proper and equitable rates to be established for
sewer service to meet these charges and the cost of operation
and maintenance and further to consider the possibility of
securing revenue from the sale and disposal of sludge
fertilizer or other plant byproducts.
3. To review the location of the sewage lift stations and the
sewage treatment plant and to advise the City as to the
areas necessary for the structures and appurtenances and
further to indicate the private right-of-way which must be
acquired before construction work commences and further to
assist the City in determining the schedule of construction
improvements, etc.
4. To so modify the plans, specifications, contract documents,
etc., now in possession of the City for interceptor sanitary
sewers, sewage pumping stations and treatment works and as
designed in 1947, in order that such plans, specifications,
etc., shall be in accord with present day conditions and
design practices with a reserve capacity for ten years in
the future and shall meet the approval of the proper authorities.

5.' To consult with the Kentucky State Health Department, the
Kentucky Stream Pollution authority, the Ohio River Valley
Sanitation'Commission and the Corps of Engineers, Louisville
District and to prepare all necessary documents as rapidly as
possible in approved form so that advertisement for construcLw
tion contracts may be made by the City ih the near future
and to further prepare a detailed construction cost estimate
and budget to determine if it is possible to include the full
project within the funds available.
6. To assist the City in every way possible to secure competitive
bids and to be in the City Engineer's office at least one day
prior to the opening of bids, to answer any questions that may
arise, to tabulate all bids, to analyze the same and to report
thereon to the City at its regular session.
7. To supply the City with all sets of plans, specifications,
contract documents, etc. as needed for the official use of
the City and State agencies having jurisdiction and further
to prepare all contractual documents for signature by the
interested parties.
8. During the construction period to provide such skilled
technically trained full-time personnel in Paducah to lay
out and to supervise the construction of the project to the
end that full compliance with the plans, specifications and
terms of the contract is obtained and that the interests of
the City are protected. Said personnel shall make periodic
verbal and written progress reports to the City, prepare all
partial payment estimates, change orders, etc, and to maintain
a complete set of field notes to be turned over to the City
Engineer at the close of the construction and further to
work in close harmony with the City Engineering, Street and
Fire Departments, so that all will be apprised of the progress
of the construction.
9. To make periodic inspection trips from the office of the
Engineers to consult with the City as to the progress of the
work, to check on the field supervision of construction and
to make a final inspection of the project with a written
report thereof to the City and further to check and approve
all shop drawings of equipment, reinforcing steel, schedules
and layouts, etc. as required by the contract documents.
10. To provide the City with a set of "as built" tracings
of the project for record purposes.
11. To consult with and adivse the officials of public utilities
such as water, gas, telephone, telegraph, etc. so that proper
precautions can be taken to prevent accidental interruptions
of service, etc.
Section B: The City agrees to pay the Engineers as follows:
1. For all the services outlined above in sub -paragraphs A-1
to A-7 inclusive a sum equal to the following percent of
the final cost of the work covered by plans and specifica-
tions, exclusive of the cost of lands, right-of-way, legal
and administrative expenses.
(a) For revision of the existing detailed construction
plans and specifications of the intercepting sanitary
sewers, sewage pumping stations and treatment works, one
and one-quarter percent, said sum to be due and
payable in the amount of eighty percent of the sum
above described being due and payable upon the award
of construction contracts and the balance to be due
and payable at the completion of the project and pro-
vided further that if, for any reason the project is
estopped or abandoned then the City sAall pay the
Engineers their fee which shall be determined by mutual
agreement between the Engineers and the City Manager
and based upon the amaunt of work done by the Engineers
in the period between the signing of this contract
and the receipt of a stop order from the City.
2. For the services of resident engineering supervision of
construction as outlined in sub -paragraphs A-8 to A-11
inclusive a monthly sum being due and payable each month
as based upon the classification of the men working on the
project and in accordance with the following schedule.

((a)) For the Chief resident engineer in charge ....$ 750.00 per mon�h
(b) For each. assistant resident engineer.... :, 650,00 per month
(c) For each engineer -inspector .. 550.00 per month
It being mutually agreed and understood that the number of
field personnel needed depends upon the action of the con-
tractor in the prosecution of the work and therefore cannot
be determined at this time and further that the City Manager
and City Engineer shall be fully apprised at all times and
agree to the necessity of any increase of the supervisory
engineering personnel beyond that of the chief resident i
engineer in charge.
Section C; It is mutually agreed and understood that the City will
place the pertinent records of the City Engineering Depart-
ment at the request of the Engineers and further that all
City departments will cooperate fully with the Engineers
to further the rapid completion of this project.
Section D; It is mutually agreed and understood that all subsurface
exploration, borings, etc. shall be made by the City at its
own exFmense but under the direction of the Engineers, pro-
vided the need for the same is mutually agreed upon as
necessary for the proper prosecution of the project.
IN WITNESS WHEREOF, the parties of the first and second parts have
hereunto set their hands and seals on the date first above written."
SECTION 2. This ordinance shall be introduced at a regular
meeting of the Board of Commissioners and remain on file for at least
one (1) week for public inspection in the completed form in which it
shall be put upon its final passage, but because of the great need
of the sewage disposal plant being constructed as soon as possible
for the health and safety of the citizens of the City, an emergency
is hereby declared to exist and this ordinance shall be in full force
and effect from and after its final adoption.
