HomeMy WebLinkAboutOrdinances Book 13, Page 159, No Ordinance Number159 ✓ x AN ORDINANCE PROVIDING FOR THE EMPLOYMENT OF AN ATTORNEY OR ATTORNEYS FOR THE COLLECTION OF DELINQUENT PERSONAL PROPERTY TAXES; PRESCRIBING THE DUTIES OF SAID ATTORNEYS AND FIXING THE AMOUNT OF COhPENSATION WHICH THEY SHALL RECEIVE FOR THEIR SERVICES BE IT O RDAINED BY THE BOARD OF CODZUSSIONERS OF THE CITY OF PADUCAH, KENTUCKY; SECTION 1. That the City Manager be, and he is hereby, authorized to employ, on a contingent fee basis, an attorney or attorneys to enforce the collection of delinquent personal property taxes owing to the City of Paducah, Kentucky. The City Manager shall cause the City Treasurer to deliver to said attorneys tax statements showing the amount of delinquent personal property taxes owing by persons, firms or corpor- ations. SECTION 2. The compensation to be paid to said attorneys shall be an amount equal to 25% of the delinquent personal property taxes, interest and penalties collected by him. SECTION 3. Each attorney so employed shall execute and deliver to the City of Paducah, Kentucky, a bond in the sum of $1000 with corporate surety approved by the City Manager, said bond being for the use and benefit of the City of Paducah for the faithful performance of the duties of said attorney and the faithful accounting of all funds coming into his hands and under his control. SECTION 4. Any contract executed by the City Manager with any attorney as provided herein shall be subject to termination at any time, provided, however, if terminated by the City Manager, the attorney shall have a period of four (4) months for the collection of all delinquent personal property tax bills in his hands, and shall be entitled to receive compensation for all collections within such period of time.
