AN ORDINANCE ACCEPTING THE BID OF E. M. FULLER FOR SALE TO
THE CITY OF PADUCAH OF #9 AND 7r -'ll LIMESTONE, KENTUCKY STATE HIGMIIAY
SPECIFICATIONS, FOR USE BY THE CITY DURING 1954; AND AUTHORIZING THE
CITY MANAGER TO ENTER INTO AND EXECUTE A CONTRACT FOR THE PURCHASE
OF SAID LIKESTONE; AND PRESCRIBING THE TERI-IS AND CONDITIONS UNDER
WHICH SAID PURCHASES SHALL BE MADE
BE IT ORDAINED BY THE BOARD OF CODWISSIONERS OF THE CITY
OF PADUCAH, KENTUCKY:
SECTION 1. That the bid of E. M. Fuller for the sale to the
City of Paducah of 7119 and #11 limestone, Kentucky State Highway
Specifications, required by the City during the year.1954 (approximately
5000 to 8000 tons) be accepted, and that the City Manager be, and he is
hereby, authorized to enter into and execute a contract for the purchase,
upon the order of the City, of all such 719 and #11 limestone to be used
during the year 1954, such contract to provide for the price of x1.90
per ton. The limestone to be delivered to any destination in the City
of Paducah, Kentucky as ordered by the Superintendent of Streets in
100 ton lots or more, and delivery to begin within twenty-four hours
after notification and continue until the required amount has been
delivered, and all weights of delivered limestone must be certified
at the city scales in Paducah, Kentucky at the expense of the said E. M.
Fuller. The contract shall require the said E. M. Fuller to furnish
representative samples of limestone, and to provide a guarantee against
advance in the marker price and guarantee a reduction in price in the
event of a decrease in the iyarket price. The said E. M. Fuller is to
post a performance bond in the sum of ;??1,500.00.guaranteeing specifi-
cations and delivery.
SECTION 2. This ordinance shall be introduced at a regular
meeting of the Board of Commissioners and remain .on file at least one (1)
week for public inspection in the completed form in which it shall be
put upon its final passage, but it being necessary for the public
health and safety of the City of Paducah, Kentucky,.that said material
be available as soon as possible for street repair work, an emergency
is hereby declared to exist and this ordinance shall be in full force
and effect from and after its adoption.
