AN ORDINANCE PROVIDING FOR THE acceptance of the bid of Brandeis Machinery
AND SUPPLY CORPORATION, FOR THE SALE TO THE CITY OF PADUCAH OF ONE BULL --CLAM
TYPE POIJERED SHOVEL OF TWO CUBIC YARD LIFTING VOLUME FOR USE IN SANITARY LAND -FILL �
OPERATIONS IN THE CITY OF PADUCAH, PRESCRIBING THE TERMS AND CONDITIONS UNDER
!lHICH SAID BID IS ACCEPTED; AUTHORIZING THE MAYOR, FOR AND ON BEHALF OF TFIE

CITY OF PADUCAH, TO ENTER INTO A CONTRACT FOR TFIE PURCHASE OF SAID BULL -CLAM;
AND APPROPRIATING THE SUM OF :13,637.00 FOR PAYMENT OF THE PURCHASE PRICE

/FLREAS, pursuant to a resolution adopted by the Board of Commissioners,
bides were requested for the sale to the City of Paducah of one bull -clam
�I type powered shovel to be used in sanitary land -fill operations in the City I
of Paducah; and

ZTREAS, the bid of Brandeis rlachiner and Supply Corporation was the only

IIbid submitted and said bid having been given consideration;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COhLAISSIONERS OF THE CITY I
II OF PADUCAH, KENTUCKY:

SECTION 1. Pkat the bid of Brandeis Machinery and Supply Corporation
�I for the sale to the City of Paducah of one Bull -clam type powered shovel for

use in sanitary land -fill operations in the City of Paducah beand the same +

is hereby accepted upon the following conditions:
(a) That the said bull -clam type powered shovel shall be of two
cubic yard lifting volume for which the City shall ,pay the sum of X13,637.00.
(b) That said bull -clam type powered shovel shall meet all of the specifi-
cations set forth in the bid submitted by Brandeis Machinery and Supply Corporatio .
l(c) Said bull --clam type powered shovel shall be delivered within a
period of thirty (30) days from. the date on which the contract of purchase is
entered into.
SECTION 2. That Robert C. Cherry, the Mayor, is hereby authorized to
enter into a contract providing for the purchase of said bull -clam type
powered shovel upon the terms and conditions set forth herein, and upon such
other terms and conditions as the City Manager and the Corporation Counsel
may require for the protection of the interest of the City of Paducah, and the
City shall not become obligated to purchase the aforesaid bull -clam type
Powered shovel until a contract has been entered into.
SECTION 3. There is hereby appropriated the sum of•,"x`13, 637.00 for payment
of the purchase price for the aforesaid bull -clam type powered shovel, the
amount thereof to be charged against the funds appropriated to Acct. of
the City of Paducah under the revised annual apportionment ordinance for the
year 1952.

SECTION 4. This ordinance shall be introduced at a regular meeting of
the Board of Commissioners and shall reamin on file one week for public
inspection in the completed form in which it shall be put upon its final
passage. As the City of Paducah presently has no system or facilities for
the collection ofgarbage and it is imperative that the necessary equipment be
immediately provided in order to preserve and protect the public health,
safety and welfare of its citizens, an emergency is hereby declared to exist
and this ordinance shall be in full force and effect from and after its
adoption.
