SECTION 1. That upon the recommendation and request of the
City Planning and Zoning Commission as shoran by its final report embodied in
a resolution adopted by it on July 21, 1950, all of the property on both sides
of l'Jashington Street to the center line of the block on either side from the
hest property line of 28th street to the east property line of Nahm Avenue is
hereby declared to be a residential district within the meaning of the City
Planning and Zoning Commission Lary and to be used for residential purposes only.
SECTION 2. All property within said area is subject to the following
restrictions:
(1) All lots in the above mentioned tract shall be known and
described as residential lots, used and maintained for residential purposes only
and no structure shall ice erected, altered, placed or permitted to remain on any
residential building plot other than one detached single family or duplex
apartment dwelling not to exceed two and one-half stories in height and a private
Garage for not more than two cars.
(2) No building shall be erected on any residential building plot
nearer than 30 feet to the front lot line, nor nearer than 5 feet to any side
lot line. No separate garage or other outbuilding shall be located nearer than
125 feet to the front lot line or nearer than 3 feet to any side lot line.
(3) No residential lot shall be resubdivided into building plots
having less than '7500 square feet of area or a width of less than 50 feet each.
(4) No dwelling costing less than ?7000.00 shall be permitted on any
lot in said tract and all residences shall front F'ashington Street.
(5) No noxious or offensive trade or activity shall be carried on
upon any lot nor shall anything be done thereon which may be or become an annoy-
ance or nuisance to the neighborhood.
(6) No trailer, basement, tent, shack, garage, barn or other outbuild-
ing erected in the tract shall at any time be used as a residence temporarily or
permanently, nor shall any residence of a temporary character be permitted. pro-
vided, however, this section shall not prevent guests or visitors of the resident;
of this area from occupying their own trailers for a period of not more than
30 days.
SECTION 3. Any property owner, tenant or other person who erects,
constructs or reconstructs any building in violation of or contrary to the afore-
said provisions of this ordinance, shall be deemed guilty of a misdemeanor, and
upon conviction thereof shall be fined in any sum not less than k10.00 nor more
than .1f100.00 for each offense so committed and each day such offense is committed
shall be deemed a separate offense and shall be subject to a separate penalty
under the provisions hereof, or the person so offending or so guilty of vio-
lation of the provisions h reof, may in addition to such fine be imprisoned
not more than fifty (50) days at the discretion of the Judge or Jury trying

SECTION 4. This ordinance shall be in full force and effect from
and after its adoption.
