HomeMy WebLinkAboutOrdinances Book 12, Page 907, No Ordinance Number907 AN ORDINANCE AUTHORIZING THE EXECUTION OF A CONTRACT WITH L. J. BRYANT, DOING BUSINESS AS LAKE SHORE PAVING COMPANY, FOR RESURFACING CERTAIN PORTIONS OF JEFFERSON STREET AND ONE BLOCK ON NORTH THIRTEENTH STREET, INCLUDING RAISING AND RESETTING OF MANHOLES, CATCH BASINS AND MOMENTS, AND PRESCRIBING THE TMIS AND CONDITIONS OF SAID CONTRACT AND DECLARING AN EMERGENCY TO EXIST. BE IT ORDAINED BY THE BOARD OF COMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1 That the City of Paducah contract with L. J. Bryant, doing business as Lake Shore Paving Company (hereinafter referred to as the "Contractor") for the resurfacing of Jefferson Street between the east property line of 2nd Street and the east curb line of North 6th Street; and also that portion of Jefferson Street between the west curb line of North 9th street and east curb line of North 12th Street; and also 13th Street between the north property line of Broadway and the south property line of Jefferson street, and said surfacing to be from gutter to gutter with full widths to street property lines at all intersections between said points and said work shall be on the following terms, conditions and specifications: The surfacing of the present pavement shall be leveled where necessary and surfaced with l;- inch application of Kentucky State Highrra.y Class "Itf, Type "BIT bituminous concrete resurfacing, said work to include the raising and resetting to grade of manholes, catch basin structures and monuments located in the area to be resurfaced. Said work also to be in accordance with the bid of the Lake Shore Paving Company dated August 253 1952 and filed with the Board of Commissioners of the City of Paducah. Said work of resurfacing shall be paid for by the City of Paducah to said Contractor on the basis of $8.00 per ton of material in place and thirty—five (35) manholes, catch basins and monuments shall be paid for on the basis of $50.00 each. Said Company shall agree to perform all of said work within a period of sixty (60) days from the date said contract is let. All work shall be performed under the direction of the City of Paducah Engineering Department and shall be paid for upon certificate of completion thereof and when approved and accepted by the City Engineer. It shall be further agreed that said Contractor will cause to be performed laboratory tests by the Kentucky State Highway Department for every (50) fifty tons of material placed by him, said tests to be run at said Contractorts expense and the results thereof to be submitted to the City of Paducah prior to payment for said work. The Contractor shall also execute a performance bond in the amount of the extimated cost of the work as shown on his bid to insure the proper performance and completion of said work, said bond to be prepared by the Corporation Counsel of the City of Paducah and to be executed by said Contractor and a Surety Company licensed to do business in the gtate of Kentucky, and shall also purchase and keep in full force and effect and file with the City of Paducah, policies of liability insurance to insure the City of Paducah and said Contractor from any and all claims for injury to persons or property of persons resulting from said work in the following amounts: 908 $10,000 for personal injury or death to any one person $20,000 for personal injury or death to more than one person resulting from the same accident, and $ 5,000 for damage to property in any one accident. Said liability insurance shall be in a good, solvent insurance company licensed to do business in the State of Kentucky. It is further provided that said materials used in paving said portion of said streets shall be weighed across the City of Paducah scales at no cost to said Contractor and said payment shall be based upon the weights determined by the Weigher of said material at the city of Paducah Scales. SECTION 2 The City 'Manager of the City of Paducah is hereby authorized and directed to execute a' contract with L. J. Bryant, doing business as lake Shore Paving Company, for the work contemplated in Section 1 hereof and on the terms and conditions therein specified. SECTION 3 This ordinance shall be introduced at a regular meeting of the Board of Commissioners and remain on file for at least one worrk for public inspection in the completed form in which it shall be put upon its final passage, but because of the lateness of the season and the health and safety of the motoring public requiring the immediate completion of said street work, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its final adoption.
