HomeMy WebLinkAboutOrdinances Book 12, Page 905, No Ordinance Number905 r AN ORDINANCE AUTHORIZING USE BY THE CITY OF PADUCAH OF CERTAIN PROPERTY ON JACKSON STREET NEAR THE LOVELACEVILLE ROAD AND AUTHORIZING A CONTRACT, AGRELZIENT AND CONVEYANCE BETWEEN THE CITY OF PADUCAH AND THE PADUCAH MATER WORKS. 14flTEAS3 on the 18th day of May 1948, a certain triangular strip of real estate on Jackson Street opposite Pvcton Park Golf Course, was sold and conveyed by the Junior Chamber of Commerce to the City of Paducah for the use and benefit of the Paducah Eater Zlorks and said property is now being occupied and used by said Paducah Water Works for a pumping station; WEREAS, it is believed to be to the mutual advantage of the Paducah Water Works and the City of Paducah for the former to release to the latter a certain portion of said property off of the east part thereof for the use and occupancy by the City of Paducah, and in consideration the city of Paducah shall'undertake to improve a driveway across the Water Works property and to keep and maintain the grounds of said property, IMEREAS, the Paducah Water Works does not need the eastern portion of said triangular tract except for passageway, NOL -1, THEREFORE, BE IT ORDAINED BY THE BOARD OF =DIISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1 That the City of Paducah by and through its Mayor enter into a Contract, Agreement and Deed with the City Water Works to contain the following provisions, terms and conditions: a. The Paducah Water Works shall release and quit claire to the City of Paducah a portion of land off the east side of the triangular tract which eras conveyed to the City of Paducah for the use and benefit of the Commissioners of Water Works' of said City by the Junior Chamber of Commerce by deed dated May 18, 1948, said conveyance being recorded in Deed Book 268 page 143, in the McCracken County Court Clerk's Office. The portion of said triangular tract to be conveyed shall be all of that property east of a line which is parallel to and 75 feet west of the east line of another tract adjacent thereto which is designated as tract No. I (Eloise MacDonald tract No. 2) in a conveyance from Eloise B. MacDonald and her husband, John K. MacDonald, to the City of Paducah dated August 27, 1952, and recorded in Deed Book 324, page 240 aforesaid Clerk's Office; a plot of said MacDonald Tract No. 2 being recorded in Plot Book I'D", page 30 in said Clerk's Office. b. The City of Paducah will agree to maintain and care for the yard area on the remaining balance of said Water Works property, not including any excavations thereon for the operation of the Water Works system or repairs made necessary by such excavations. 906 C. The City of Paducah also will surface the present driveway extending from one end of said triangular tract to the other behind the pumping station and will keep same in repair without cost to the Water Works; The crater Works shall also have the right to use so much of said driveway which extends over that portion of the triangular tract to be conveyed to said City. Both City and City inter Works shall have free acess to and use of all of said driveway, but said driveway shall not be open for use by the traveling public.
