HomeMy WebLinkAboutOrdinances Book 12, Page 877, No Ordinance Number877 AN ORDINANCE PROVIDING FOR AND AUTHORIZING THE EMPLOYMENT OF BLACK & VEATCH, CONSULTING ENGINEERS, IN CONNECTION IffTH SEWER DEVELOPMENT AND PUMPING STATION IN THE CITY OF PADUCAH NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMASISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1 That the firm of Black & Veatch, Consulting Engineers, shall be employed in connection *ith the sewer development and pumping station in the City of Paducah enbraced in project Ky-CF-8, and that the Mayor shall be, and he is hereby, authorized to execute and deliver on behalf of the City of Paducah an agreement or contract of employment of the said firm in words and figures as follows: "CONTRACT FOR ENGINEERING SERVICES "THIS CONTRACT, made and executed in triplicate this day of , 1952, by and between the City of Paducah, Kentucky, a municipal corporation hereinafter called the City, party of the first part, and Black & Veatch, Consulting Engineers, of Kansas City, Missouri, hereinafter called the Engineers, parties of the second part. WITNESSETH: That in consideration of the mutual covenants herein contain ed, the City hereby agrees to employ the Engineers to perform the services hereinafter outlined and agrees to pay them for such services according to the schedule of fees herein contained. Section A:. The services which the Engineers agree to perform are: 1. To modify the plans, specifications, contract documents, etc. now the property of the City, for the storm crater relief sewers designed for construction in 1947 and located in Noble Park, 30th Street, 27th Street, Cruse Avenue and along the branch and 32nd Street in order that said plans, specifications, contract documents, etc. shhll meet approval of the Federal Housing and Home Finance Agency (HHFA). 2. To consult with the HHFA as to the required set-up, wage scales, etc., and to prepare all necessary documents as rapidly as possible in approved form so that advertisement for construction contracts may be made by the City in the near future in order to comply with the terms of the grant offer accepted by the City. 3. To make all necessary field surveys, investigations and designes, specifications, etc. for modification and additons to the existing flood control pumping station in Noble Park so that it may properly function after the construction of the storm water relief sewers above described, to submit these plans, etc. to any governmental agency having a financial or regulatory interest therein and to secure their approval thereto. 4. To make all necessary drawings and technical descriptions of the rights-of-way needed for the construction of these sewers and to furnish the Corporation Counsel Frith sufficient copies thereof to serve his needs and to assist him in securing of such easement, rights-of-way,etc. 878 5. To assist the City in every way possible to secure competitive construction bids, to be in the City Engineer's office at least four (4) days before the opening of bids to answer any engineering questions that may arise, to tabulate all bids, to analyze the same and to report thereon to the City. 6. To supply the City with all sets of plans, specifica- tions, contract documents as needed for official use of the City, State or governmental agency and further to prepare all contractual documents for signature by the interested parties. 7. During the construction period to provide such skilled techdically trained full time personnel in Paducah to lay out to supervise the construction of the project to the end that full compliance with the plans, spec- ifications and terms of the contract is obtained and j that the interests of the City are protected. Said personnel shall make periodic verbal and written progess reports to the City, prepare all partial i payment estimates, change orders, etc. and to maintain a complete set of field notes to be turned over to the City Engineer at the close of the construction and ! further the work in close harmony with the City Engineer- ing, Street and Fire Departments so that all will be apprised fo the progress of the construction. 8. To make periodic inspection trips from the office of the Engineersto consult with the City as to the progress of work, and to check on the field supervision of the i construction and to make a final inspection of the I project with a written report thereof to the City and further to check and approve all shop drawings of equipment, reinforcing steel schedules and layouts, etc. as required by the contract documents. 9. To provide the City with a set of "as built" tracings of the project for record purposes. 10. To consult with and advise the officials of public utilities such as water, gas, telephone, telegraph, etc. so that proper precautions can be taken to prevent "accidental interruptions of service, etc. Section B: The City agrees to pay the Engineers as follows: 1. For all the services outlined above in sub -paragraphs A-1 to A06 inclusive a sum equal to the following percent of the final cost of the work covered by plans and specifications, exclusive of the cost of lands, right-of-way, legal and administrative expenses. ' (a) For revision of the existing detailed construction plans and specifications of the storm water relief sewers, one-half of one percent. j I (b) For design and specifications of the additions to the Flood Control Pumping Station in -Noble j Park, six percent. Said sums to be due and payable in the amount of eighty percent of the sum above described being due and payable upon the award of construction contracts and the balance to be due and payable at the completion of the project. 2. For the services of resident engineering supervision of construction as outlined in sub -paragraphs A-7 to A-10 inclusive a monthly sum being due and payable each month as based upon the classification of the men working on the project and in accordance with the following schedule. (a) For the chief resident engineer in charge ..... $700 per Month (b) For each assistant residentengineer............ 600 per Month (c) For each engineer -inspectors ...................500 per Month It being mutually agreed and undersood that the number of field personnel needed depends upon the action of the contractor in the prosecution of the work and therefore cannot be determined at this time and further that the 879 City shall be fully appraised at all time of the necessity of any increase of the supervisory engineer- ing personnel beyond that of the chief resident engineer in charge. Section C: It is mutually agreed and understood that the City shall not be liable for the payment of the sums contemplated in Section B, except from funds received from the Federal government and which were included in the application for a grant which was approved by the HHFA. Section D: It is mutually agreed and understood that the City will place the pertinent records of the City Engineering Department at the request of the Engineers and further that all deparments will cooperate fully with the Engineers to further the rapid completion of this project.
