OR PRIVILEGE; FIXING THE PENALTIES FOR THE VIOLATION THEREOF; AMID PRO-

R. A. BRIDGUATER SANITARY GARBAGE DISPOSAL COMPANY,�PROVIDING FOR THE
AI.?EBIDAMENT OF SAID FRANCHISE IPI CONFORMITY !'1ITH THE PROVISIONS OF THIS
ORDINANCE:
Whereas, R. A. Bridgwater, doing business under the firm name
of R. A. Bridgwater Sanitary Garbage Disposal Company, has become the
purchaser by a franchise created under an ordinance entitled: "Aid ORDI-
NAiICE CREATING A FRANCHISE OR PRIVILEGE TO FURNISH SERVICES AND FACILITIES
FOR THE COLLMTION AiID DISPOSAL OF GARBAGE AND RUBBISH IN THE CITY OF
PADUCAH, KENTUCIU; PROVIDING FOR 7H E SALE OF SAID FRANCHISE OR PRIVILDCE;
FIXING THE PE14ALTIES FOR THE VIOLATION THEREOF; AND PROVIDING A SEVERABILITY
CLAUSE", and,
,.hereas, the said R. A. Bridgwater has agreed that Section 8 of said
franchise ordinance may be amended under a provision by which he will grant
to the City of Paducah the right and privilege to transport from his per-
manent disposal site sufficient earth for covering of all open dumping grounds
within the city in consideration of the agreement of the City of Paducah to
permit the dumps within the city to be used by him for a period of -thirty days
while his own permanent site is being made available for that purpose, which
site has not yet been approved by the Board of commissioners.
NODI, THEREFORE, BE IT ORDAINED BY THE BOARD OF C0131ISSIONERS
OF THE CITY OF PADUCAH, KENTUCIIY:
SECTION 1. That Section 8 of an ordinance containing the title
quoted above, which was adopted by the Board of Commissioners on November
29, 1949, be and the same is hereby amended and re -ordained so that said
section as amended and re -ordained shall read as followe:
"SECTION 8. The Grantee, R. A. Bridgwater, shall dispose of all
garbage and rubbish collected by him, his agents and employees by using the
sanitary land fill method, which for purposes of this franchis is defined to
mean that all garbage and rubbish shall be buried the same day it is collected
and shall be covered by at least two feet of earth thoroughly compacted (two
feet after compacting has been completed) by a bulldozer or other heavy equip-
ment generally used ih this type of operation; provided, however, that garbage
may be otherwise disposed of, such as beinS used to feed livestock or as
fertilizer, if appropriate public health authorities approve such disposal.

Such sanitary land fill operations shall be conducted on land to be acquired
or leased by i;. A. Beidgwater at his expense. The said R. A. Brid3wa ter shall
give to the Board of Commissioners and the City -County Board of Health written
notice of any site selected by him for the disposal of garbage and rubbish and
if such site is not disapproved by either of said board within fifteen days
after receipt of said notice, such site may be used by him until the selection
of another site in the sane manner. Provided, however, that until a site has
been approved by the Board of Conunissioners and has been made available for the dis
posal of garbage and rubbish, but not exceeding a period of thirty days from this
date, the said R. A. Brid.,water shall have the right and privilege to dump all
garbage and rubbish collected by him at the city dump on North 5th Street in the
City of Paducah, and he shall not be required to cover same over during that per
In consideration of the right and privilege granted to the said R.A.
Brid.,water to use the aforesaid city dump for a periodnoteaceeding thirty
days, the said R.A.Bridgwater agrees that the city may, at any time and
without charge, transport from the permanent site selected by him as a gar-
bage disposal site as herein provided such quantities of earth as may be
necessary to cover over all of the open dumps located in the city. He shall
make loose dirt available for hauling by the city from the garbage disposal
site selected by him to the several open dumps within the city and shall
also furnish without expense to the city a bulldozer and the labor necessary
for covering over all garbage and rubbish at such dumping grounds by use
of the dirt hauled by the city frorn the dumping site selected by him."
SECTIOid 2. The lvlayor is hereby authorized and empowered for and
on behalf of the City of Paducah, to enter into a contract with the said
R. A. Bridwater, said contract to contain the agreements and provisions set
forth in the aforesaid Section 8 as amended herein.
SECT -1011 3. This ordinance shall be in full force a effect from
and after its adoption.
