AN ORDINANCE APPROVING THE FINAL REPORT OF THE PLANNING AND ZONING
COMMISSION OF THE CITY OF PADUCAH AND MUNICIPAL AREA, McCRACKEN COUNTY,
KENTUCKY, RESPECTING THE SUBDIVISION OF PROPERTY KNOWN AS "CORNELL PLACE NO. 3",
FRONTING ON THE EAST SIDE OF CORNELL STREET NORTH OF OLD MAYFIELD ROAD, APPROVING
THE PLAT OF SAID SUBDIVISION AND SUBDIVIDING SAID PROPERTY
BE IT ORDAINED BY THE BOARD OF COlvIIISSIONERS OF THE CITY OF PADUCAH,
KENTUCKY:
SECTION 1. That a resolution adopted by the Planning and Zoning Comm-
ission of the City of Paducah and Municipal Area, McCracken County, Kentucky, on
!Tay 9, 1952, entitled. °n Rh5OLUTION CONSTITUTING THE FINAL REPORT OF THE
PLaNNING A::u ZOhING COhfti!SSION OF THE CITY OF PADUCAH AND MUNICIPAL AREA,
McCRACKEN COUNTY, KENTUCKY, ON THE PROPOSED SUBDIVISION OF PROPERTY KNOWN AS
'CORNELL PLACE No. 131, WHICH FRONTS ON THE FAST SIDE OF CORNELL STREET NORTH
OF THF OLD MAYFIELD POAD", and the plat accompanying the same, which is more
specifically referred to hereinafter, be approved as the final report of said
commission respecting the matters therein set forth.
SECTION 2. That the subdivision of property located in the City of
Paducah and described as follows:
"Commencing at the northeast corner of Cornell Street and
the Old Mayfield Road as laid out in the J. C. Pace Addition to
the City of Paducah, Ky.; thence N 10 deg. 41 min. 00 sec. E.
along the east line of Cornell Street a distance of 335.29'
thence on a 19.05 deg. curve to the left a distance of
129.921, thence oNa 23.546 deg. curve to the right a
distance of 105.11,; thence N 10 deg. 41 min. 00 sec E.
a distance of 48.87'; thence S 79 deg. 19 min. 00 sec. E
a distance of 125'; thence S 10 deg. 41 min 00 sec W.
a distance of 80.6 feet; thence N 79 deg. 21 min 00 sec. W
a distance of 6.13'; thence S 2 deg. 20 min. 00 sec W. a
distance of 478.94' to the right of way of the Old Mayfield
Road; thence S 78 deg. 11 min 00 sec W along the line of the
Old 14ayfield Road a distance of 150' to the place of beginning."
as shown on the plat prepared by Charles E. Day, Surveyor, and entitled
"Cornell Place No. 3", which said plat has been approved by said Commission
and bears the signatures and acknowledgements of the Chairman of said Commission
and the City Engineer, dated &ay _ 1952, be, and it is hereby approved, and
said property is hereby declared to be subdivided as shown on said plat.
That strict compliance with the provisions of an ordinance entitled:
"AN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING
C01-11ISSION ESTABLISHING RULES AND REGULATIONTS RELATING TO THE LAYING OUR,
SUBDIVIDING AND PLATTING OF LANDS WITHIN THE CITY OF PADUCAH AND WITHIN THREE
MILES OF THE CITY LIMITS, ADOPTING SAID RULES AND REGULATIONS RECOm'.ENDED IN
THE FINAL REPORT OF THE CITY PLANNING AND ZONING COMMISSION, AND PRESCRIBING
THE PENALTY TO BE IMPOSED FOR THE VIOLATION OF THE RULES AND REGULATIONS SET FORT

1945", which was adopted by the Board of Commissioners on A:arch 27, 1945,

would impose an undue hardship upon the owner of said property, and such pro-
visions, to the extent hereinafter indicated, are hereby waived.
That in lieu of placing stones, markers and monuments on said property
and certifying such placement on said plat, the surveyor and the owner of said
property may certify on said plat that within a period of 9 months from the
adoption of this ordinance they will place said stones, markers and monuments
as shown on said plat, provided, however, that as a condition to this authoriza-
tion said owner shall furnish bond with good and sufficient surety in the
amount of ,x1,000.00, which said bond shall be in form similar in substance to
those heretofore furnished in connection with the subdivision of "Cornell
Place" and Cornell Place ko. 211, pursuant to ordinance on record in ordinance
Book 12, pages 351 and 519.
SECTION 3. That if any section, paragraph or provision of this ordinance
shall be found to be inoperative, ineffective or invalid for any cause, the
deficiency or invalidity of such section, paragraph or provision shall not affect
any other section, paragraph or provision hereof, it being the purpose and intent
of this ordinance to make each and every section, paragraph and provision
hereof separable from all other sections, paragraphs and provisions, so that if
any section., paragraph or provision hereof shall be found to be invalid, inoperati
or ineffective, the deficiency or invalidity thereof shall not affect any other
section, paragraph or provision hereof.
SECTION 4. This ordinance shall be in full force and effect from and
after the date on which the aforesaid plat is lodged for record in the office
of the Clerk of the Y.cCracken County Court.
