AN ORDINANCE ACCEPTING THE WATER PIPE LINES AND WATER MAINS CO NVEYED BY
THE WOODLAWN OAKDALE =,511UNITY WATER COMPANY, A CORPORATION, TO THE CITY OF
PADUCAH FOR THE USE AND BENEFIT OF THE PADUCAH WATER WORKS AND PRESCRIBING THE
TERMS OF ACCEPTANCE
WHEREAS, by a deed of conveyance dated the 30th day of August, 1951, the
Woodlawn Oakdale Community Water Company, a corporation of State of Kentucky,
conveyed to the City of Paducah, a municipal Corporation of the second class, for
the use and benefit of the Paducah Water Works certain water pipe and mains
consisting of four (4) inch and six (6) inch transite water pipe installed along
and under the Old Benton Road, Oaks Road and Kentucky Street, two (2) inch steel
water pipe installed along and under the Old Benton Road copper service lines to
the four (4) inch, six (6) inch and two (2) inch water mains, all of which are
located in McCracken County, Kentucky, the said six (6) inch trgnsite water pipe
line being connected to the six (6) inch water main of the Paducah Water Works
at or near the city limits of Paducah, Kentucky, and
WHEREAS, said deed of conveyance further conveyed to said city all easements,
rights of way, materials and tools held and owned by the said community water comp
and
WHEREAS, by said deed the said Paducah Water Works agrees to operate and
maintain said water lines and water pipe lines and to continue to serve all
present consumers of the community water company under the same terms and con-
ditions under which they are now being served, and
WHEREAS, it is .further agreed by the parties to said conveyance that for a
period of .five (5) years from and after the date of said conveyance, or until
the territory now being served by said community water company may be taken into
the city limits of Paducah, Kentucky, the said water company agrees to charge
and collect the sum of One Hundred Fifty ('D150.00) Dollars as a tapping charge
for any new consumers receiving water in the service lines to the city's mains
and lines above described, and whose property abuts the Old Benton Road, Oaks Road
or Kentucky Street, and
WHEREAS, it appears to be to the best interest of the City of Paducah and
the Paducah Water Works that said conveyance and the water pipe lines therein
be accepted by said city, and
WHEREAS, it further appears from the recommendations of the Commissioners
of Water Works that said pipe lines so conveyed meet the standard of qualificati
set by said board, and
WHEREAS, said Board has further recommended that it be permitted to accept
applications and approve connections to said water pipe lines.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:

SECTION .1. That the Water Pipe lines, easements, rights of way, material
and tools of the Woodlawn Oakdale Community Water Company, a corporation of the
State of Kentucky, be accepted by said city and that said instrument of conveyance
dated the 30th day of August, 1951 from said Woodlawn Oakdale Community Water
Company to the City of Paducah for the use and benefit of the Paducah Water Works
be approved pursuant to the terms and conditions of said conveyance, and that
from and after the passage of this ordinance the Commissioners of Water Works of
the City of Paducah be authorized and permitted to accept and approve applications
and contracts for water service connections to said water pipe lines. Said
instrument of conveyance and terms therein is accepted with the understanding that
persons presently using water from the Paducah Water Works through pipes and
mains referred to in said instrument of conveyance dated August 30th, 1951, are
doing so pursuant to contracts with the Paducah Water Works and pursuant to
approvalof same by the City of Paducah on terms and conditions as expressed in
the motion to approve the petition of Edwin Farley and others for authority to
lay and construct water mains which was approved by the Board of Commissioners on
April 2, 1946.
SECTION 2. This ordinance shall be in full force and effect from and after
its passage.
