AN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING
COMMISSION RESPECTING THE ZONING OF THE PROPERTY ABUTTING THE SOUTH LINE OF
STREET BETWEEN THE ILLINOIS CENTRAL RAILROAD RIGHT-OF-WAY AND THE OLD MAYFIELD
ROAD, MAKING SAID PROPERTY SUBJECT TO CERTAIN RESTRICTIONS AND FIXING PENALTIES
FOR VIOLATIONS OF SUCH RESTRICTIONS
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH,
KENTUCKY:
SECTION 1.
That a resolution adopted by the City Planning and Zoning Commission on
August 17, 1951, entitled: "A RESOLUTION RESPECTING THE FINAL REPORT OF THE CITY
PLANNING AND ZONING COMMISSION ON THE PROPOSED ZONING OF THE PROPERTY ABUTTING THE
SOUTH LINE OF QUARLES STREET BETWEEN THE ILLINOIS CENTRAL RAILROAD RIGHT OF WAY
AND THE OLD MAYFIELD ROAD", be approved as the final report of said Commission
respecting the matters therein set forth.
SECTION 2.
That the property described below be, and it is hereby, zoned for general
business purposes, subject to the restriction set forth in Section 3 hereof:
"Beginning at the southeast corner of the intersection
of Quarles Street and the Old Mayfield Road; thence in
a southerly direction along the east line of the Old
Mayfield Road 240.3 feet to a point in said line; thence
in an easterly direction at an interior angle of 90
degrees 131.9 feet to a point; thence in a southerly
direction at an exterior angle of 270 degrees 2$.3$ feet
to a point; thence in an easterly direction at an interior
angle of 102 degrees 17 minutes 20 seconds 876.74 feet,
more or less, to a point in the west line of the right -
of way of the Illinois Central Railroad; thence in a
northerly direction along the west line of said right-
of-way 204.25 feet, more or less, to a point in the south
line of Quarles Avenue; thence in a westerly direction
along the south line of Quarles Avenue 1014.7 feet, more
or less to the point of beginning."
SECTION 3.
That said property be; and it is hereby, made subject to the following
restriction:
"No business shall be conducted on said
property and no building shall be erected
thereon unless and until the type of the
proposed business and the plans and speci-
fications of the proposed construction
have first been approved by the City Planning
and zoning Commission."
SECTION 4.
That any property owner, tenant or other person, firm or corporation who
erects; constructs or reconstructs any building in violation of, or contrary to,
the provisions of this ordinance, or who breaches or violates any provision of this
ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof sha
be fined in any sum not less than Ten ($10.00) Dollars nor more than One Hundred
($100.00) Dollars for each offense so committed, and any person so offending or so
guilty of a violation of the provisions hereof, may, in addition to such fine, be
imprisoned not more than fifty (50) days at the disbretion of the Judge or Jury
trying the case, and in the event the offense or violation is a continuing one,
extending from one day until the next, a separate offense or violation shall be
deemed to have been committed on each day involved and shall be subject to a separa
to penalty under the provisions hereof.
SECTION 5.
That if any section, paragraph or provision of this ordinance shall be
found to be inoperative, ineffective or invalid for any cause, the deficiency
or invalidity of such section, paragraph or provision shall not affect any other
section, paragraph or provision hereof, it being the purpose and intent of this
ordinance to make each and every section, paragraph and provision hereof separable
from all other sections, paragraphs and provisions, so that if any section,
paragraph or provision hereof shall be found to be invalid, inoperative or ineffec-
tive, the deficiency or invalidity thereof shall not affect any other section,
