AN ORDINANCE AUTHORIZING THE CONVEYANCE TO THE COMMONWEALTH OF KENTUCKY
OF A DEED OF CONVEYANCE TO CERTAIN STREETS IN THE CITY OF PADUCAH, KENTUCKY,
WHICH ARE TO BE MAINTAINED BY THE DEPARTMENT OF HIGHWAYS UNDER AND PURSUANT TO THE
PROVISIONS OF CHAPTER 30 OF THE ACTS OF THE GENERAL ASSEMBLY OF 1942, AND PRESCRIBI�
THE TERMS AND CONDITIONS UNDER WHICH SAID STREETS SHALL BE CONVEYED
THAT WHEREAS, under and pursuant to the provisions of Section 177,010,
et seq., of the Kentucky Revised Statutes, being Chapter 30 of the Acts of 1942, th
of Paducah, Kentucky, and the Commissioner of Highways of the Commonwealth of
Kentucky, have heretofore entered into a Contract dated August 24, 1951, and by
the terms of which the Department of Highways designated, among other streets, a
portion of the Paducah Belt Line from 28th street along Jackson street to the
Lovelaceville Road, as a necessary connecting link of Federal and State highways
passing through said city, which property or street is more particularly described
as follows:
"Paducah Belt Line, beginning at the intersection of
Twenty -Eighth Street and Jackson Street; thence ex-
tending in a westerly direction along Jackson street
to the Paducah-Lovelaceville Road (including the section
between Station 25/92 and Station 37 94 of U. 58 (6)),
a distance of approximately 0.643 miles."
AND WHEREAS, it was provided under Section 177,045 of the Kentucky
Revised Statutes that when the Commissioner of Highways has designated any street
in the city as a part of the state primary road system, no construction, recon-
struction, maintenance or repair of the street shall be done by the Department
of Highways until the City has conveyed to the Commonwealth of Kentucky, without
cost to the state, all rights-of-way it owns upon which the street is located;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY
OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor and City Clerk be, and they are hereby
authorized to execute, for and on behalf of the City of Paducah, Kentucky, a deed
of conveyance to the Commonwealth of Kentucky conveying the right of way to and
easement in, over and through the above described street in consideration of the
agreement by the Department of Highways to assume the liability for the con-
struction, reconstruction and maintenance of same as agreed to in the aforesaid
contract dated August 24, 1951, the same to be conveyed for the uses and purposes
defined in Kentucky Revised Statutes, Chapter 177; provided, however, that should
said street be abandoned by order of the Department of Highways, said rights -of -;-.,ay
and easements shall automatically revert to the City of Paducah; provided further
that the deed shall provide that the purpose of this deed is to amend the deed of
November 22, 1950, (of record in the office of the Clerk of the McCracken County
Court in Deed Book 292, page 463) by including instead of excluding the section
between Station 25/92 and Station 37/94 of U 58(6) in the second item of said deed
the Paducah Belt Line Road. And, it is agreed by the parties hereto, that in all
respects this deed is supplemental to, and not in lieu of, the deed of October 27,

1943, of record in Deed Book 223, page 401, and the deed of Nobember 22, 1950, in
Deed Book 292, page 462, both in the office of the Clerk of the McCracken County
court.
SECTION 2. This ordinance shall be in full force and effect from and
after its adoption.
