AN ORDINANCE PROVIDING FOR THE HIRING OF G. ANTHONY JOHNSTON AS ARCHITECTURAL
ENGINEER IN THE PLANNING AND eONSTRUCTION OF A FIRE STATION BUILDING AT THE NORTH;VES''
CORNER OF THE INTERSECTION OF 12TH AND BURNETT STREETS IN THE CITY OF PADUCAH; PRE-
SCRIBING THE TERMS AND CONDITIONS OF HIS EMPLOYMENT AND AUTHORIZING STUART JOHNSTON,
MAYOR OF THE CITY OF PADUCAH, TO SIGN A CONTRACT OF EMPLOYMENT FOR ANDON BEHALF OF
THE CITY OF PADUCAH
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah employ G. Anthony Johnston to act as
Architectural Engineer in the planning and construction of a fire station building
on property owned by said city at the northwest corner of the intersection of 12th
and Burnett Streets within said city, that the said G. Anthony Johnston as architec-
tural engineer shall fully cooperate with the City Manager, Building Inspector, Fire
Chief, and such other officers and employees of the city as the City Manager may
designate in the planning and construction of said building; that the terms and
(conditions of said employment shall be as follows: the architectural engineer shall
prepare preliminary sketches and estimates of said building, same to be considered
approximations-onlyl he shall prepare general working drawings, specifications and
proposal formsl he shall assist the City Manager in advertising for and accepting
bids and shall advise the city in the matter of letting contracts; he shall prepare
necessary fullsize details and check shop drawings; he shall provide adequate
(construction supervision and inspection during the course of construction of said
building until said building is accepted by the city and he shall issue certificate
of payment to contractors; and said engineer will endeavor to guard the city against
defects and deficiencies of the work of contractors but not to guarantee the perfor-
mance of their contracts. In consideration of the foregoing professionsl service the
Architectural Engineer shall be paid a fee equal to six (60) percent of the total
Bost of said building, not including the architectural engineer's fee and payment of
said fee shall be as follows: a sum equal to twenty percent (200) of the basic fee J
of the reasonable estimateicost, said reasonable estimated cost shall be agreed
upon as ;;40,000.00; a sum sufficient to increase the payments on his fee to sixty
(60%) percent of the basic rate upon completion of contract drawings and specification
said payment to be computed upon the aforesaid reasonable estimated cost, or if bids
for the entire construction have been received and accepted, upon the total of such
bids. After bids have been accepted for the construction of said building and
appurtenances, then the balance of said architectural engineer's fee shall be paid him
in proportion to the amount of service rendered, computed upon the actual cost of
the construction as contracted for. It shall be agreed also that the cost of con-
struction shall not include the cost of furnishing or equipping said fire station
building and shall include only such construction as is actually performed upon
contracts let in conformity to the plans for constructing said building and drawings
thereto. It is also agreed that should construction be abandened after final plans

and specifications have been completed by the architectural engineer and accepted
the Board of Commissioners the Architectural Engineer shall be paid a fee equal to
four and one-half percent (410o) of the reasonable cost of said construction work
or if bids have been received and accepted then said fee will be based upon the
bids as accepted.
SECTION 2. Stuart Johnston, the Mayor of the City of Paducah, whose signatu
bhall be attested by Sarah Thurman, the City Clerk, is hereby authorized and em-
powered for and on behalf of the City of Paducah to subscribe his name to a contrac
with G. Anthony Johnston, architectural engineer, said contract to contain the term
and conditions of employment and to provide the fees provided in Section 1 herein.
SECTION 3. This ordinance shall be introduced at a regular meeting of the
Board of Commissioners and remain on file at least one week for public inspection
in the completed form in which it shall be put upon its final passage. Because
of the great increase in population and in the building of new construction in
the City of Paducah following announcement of the construction of an atomic bomb
plant on the site of the Kentucky Ordnance Works near the city, the present fire
protection Facilities are in need of additional fire stations and fire fighting
facilities; the public health and safety requiring that this ordinance be made
immediately effective an emergency is declared to exist and this ordinance shall
be in full force and effect from and after its adoption.
