HomeMy WebLinkAboutOrdinances Book 12, Page 407, No Ordinance NumberAN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING CO$II,i- ISSION RESPECTING THE ZONING OF SUNSET COURT, AS SHOWN BY PLAT OF RECORD IN PLAT BOOK A, PAGES 244 AND 245, Mc-CRACKEN COUNTY COURT CLERK'S OFFICE, MAKING SAID PROPERTY SUBJECT TO CERTAIN RESTRICTIONS AND FIXING PENALTIES FOR VIOLATIONS OF SUCH RESTRICTIONS BE IT ORDAINED BY THE BOARD OF CODUAISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the City Planning and Zoning Commission on June 1, 1951, entitled: "A RESOLUTION RESPECTING THE FINAL REPORT OF THE CITY PLANNING AND ZONING COMMISSION ON THE PROPOSED ZONING OF THE PROPERTY KNOWN AS 'SUNSET COURT' 11, be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the property known as "Sunset Court", as shown by plat of record in Plat Book A, pages 244 and 245, in the office of the Clerk of the McCracken County Court, to theextent that it is within the corporate limits of the City of Paducah, be, and it is hereby zoned for residential purposes only and shall be subject to the following restrictions: (1) All lots in Sunset Court shall be, and shall be known and described as, residential lots, to be used and maintained for residential purposes only, and no structure shall be erected, altered or placed on any such lot other than one detached single-family dwelling, or one two-family duplex apartment dwelling, not to exceed two stories in height (exclusive of basement) and a private garage for not more than two (2) automobiles. (2) All residences shall front the streets in the manner in which the lots are laid out. (3) The ground floor square foot area of any residential structure, exclusive of one story porches and garages, shall not be less than 1000 square feet. (4) No noxious or offensive trade or activity shall be carried on upon any lot, nor shall anything be done thereon which may be or may become an annoyance or nuisance to the nieghborhood. (5) No trailer, basement, tent, shack, garage, barn or other outbuilding erected or placed on the said property shall at any time be used as a residence temporarily or permanently, nor shall any residence of a temporary character be permitted. SECTION 3. That any property owner, tenant or other person, firm or corporation who erects, constructs or reconstructs any building in violation of, or contrary to the provisions of this ordinance, or who breaches or violates any provision of this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereo shall be fined in any sum not less than Ten ($10.00) Dollars nor more than One Hundred ($100.00) Dollars for each offdnse so committed, and any person so cffendin or so guilty of a violation of the provisions hereof, may, in addition to such fine, be imprisoned not more than fifty (50) days at the discretion of the Judge or Jury trying the case, and in the event the offense or violation is a continuing one, extending from one day until the next, a separate offense or violation shall be deemed to have been committed on each day involved and shall be subject to a separate penalty under the provisions hereof. 407 o 408 SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect a other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and ebery section, paragraph and provision hereof sepa- rable from all other sections, paragraphs and provisions, so that if any section, paragraph or provision hereof shall be found to be invalid, inoperative or ineffec- tive the deficiency or invalidity thereof shall not affect any other section, paragraph or provision hereof.
