AN ORDINANCE PROVIDING FOR THE PAYMENT OF ONE (?1.00) DOLLAR TO H. P. TERR
AND HIS WIFE, CHRISTINE M. TERRELL FOR AN EASEMENT OVER CERTAIN REAL ESTATE
LOCATED AT THE NORTHEAST CORNER OF THE INTERSECTION OF 10TH AND PINE STREETS TO
BE USED IN CONNECTION WITH THE CONSTRUCTION AND REPAIR OF THE FLOODWALL; PRE-
SCRIBNG THE TERMS AND CONDITIONS OF SAID EASEMENT AND AUTHORIZING ACCEPTANCE
THEREOF
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH,
KENTUCKY:
SECTION 1. That the City of Paducah purchase from H. P. Terrell and his
wife, Christine M. Terre;;, for the sum of One ($1.00) Dollar upon certification
by the Corporation Counsel that said parties hold a good marketable title to the
hereinafter described property and upon execution and delivery by said parties
of an instrument in writing conveying to the City of Paducah an easement for the
construction and repair of the floodwall to the City of Paducah at or near Pine
Street diversion sewer over and on the following described property, to -wit:
"Beginning at the northeast corner of the intersection of the
10th and Pine Street property lines; thence with the
east property line of Pine Street and in a northerly direc-
tion 150 feet; thence in an easterly direction and parallel
with 10th street 30.5 feet; thence in a southerly direction
150 feet to the north property line of 10th Street; said line
being 30.50 feet from and parallel to the east property line
of Pine Street; thence in a westerly direction and with the
north property line of 10th street 30.50 feet to the point
of beginning."
Being a part of the same property devised to H. P. Terrell
by Richard G. Terrell by Will probated and recorded on
November 30, 1937, in Will Book "G", page 425, b.,cCracken
County Court Clerks Office.
SECTION 2. The sum of One (;1.00) Dollar to be paid for the aforesaid
easement shall be charged to Account Number 12$$ and the City Manager and the
City Treasurer are authorized to deliver a check drawn on the general fund of
the City of Paducah in said sum payable to said H. P. Terrell and wife, Christine
M. Terrell upon delivery by them to the City Manager of a properly drawn and
executed instrument conveying the easement described in Section 1 to the City
of Paducah.
SECTION 3. This ordinance shall be in full force and effect from and
after its adoption.
