AN ORDINANCE PROVIDING FOR THE PAYMENT OF TWO HUNDRED FIFTY (:250.00) DOLLARS
TO F. M. WEATHERINGTON AND WIFE, NELLIE WEATHERINGTON, FOR A PERMANENT RIGHT OF WAY
AND EASEMENT OVER CERTAIN REAL ESTATE LOCATED NEAR THd INTERSECTION OF THE FLOODWAL
AND HUSBANDS ROAD TO BE USED IN CONNECTION WITH THE CONSTRUCTION AND REPAIR OF THE
FLOOD114ALL; PREUCRIBING THE TERMS AND CONDITIONS OF SAID EASEMENTS AND AUTHORIZING
ACCEPTANCE THEREOF
BE IT ORDAINED BY THE BOARD OF COhviISSIONERS OF THE CITY OF PADUCAH,
KENTUCKY:
SECTION 1. That the City of Paducah purchase from F. A'1. Weatherington and
wife, Nellie Weatherington, for the sum of Two Hundred Fifty (,p50.00) Dollars
upon certification by the Corporation Counsel that said parties hold a good
marketable title to the hereinafter described property and upon execution and
delivery by said parties of an instrument in writing conveying to the City of
Paducah an easement for the construction and repair of the floodwall to the City
of Paducah at or near the intersection of the floodwall and Husbands Road in
McCracken County, Kentucky, over and on the following described property, to -wit:
"Beginning at a point in the center of Husbands Road
and the center of a concrete bridge spanning Island Creek,
said point being the common corner of James McKendree and
F. M. Weatherington property; thence in a northerly direc-
tion'and along the center line of the Husbads Road 60.56
feet; thence at an interior angle of 106 degrees and 52
minutes and in a northwesterly direction 986.1 feet; thence
at right angles and in a southwesterly direction X15 feet;
thence at right angles and in a southeasterly direction $60
feet more or less to the McKendree north line; thence in an
easterly direction 167 feet more or less to the point of
beginning."
Being a part of the same property conveyed to Frank
Weatherington and his wife, Nellie Weatherington, by deed
dated February 3, 1938, in Deed Book 195, page 96
McCracken County Court Clerk's Office.
Also as a part of the consideration of the aforesaid sum said instrument shall
also convey to the City of Paducah a permanent right of entry across the land of
F. M. Weatherington, said right of entry or easement being more particularly
described as follows, to -wit:
"A strip of ground 50 feet in width beginning at a
point where the north right of way line described above
intersects the west line of the Husbands Road and ex-
tending in a northerly direction from said north right
of way line along the west side of the Husbands Road
a distance of 555 feet."
SECTION 2. The sum of Two Hundred Fifty (;250.00) Dollars to be paid for the
aforesaid permanent right of way and easement shall be charged to Account Number
12$$ and the City Manager and the City Treasurer are authorized to deliver a check
drqwn on the general fund of the City of Paducah in said sum payable to said

F. M. Weatherington and wife, Nellie Weatherington upon delivery by them to the
City Manager of properly drawn and executed instruments conveying the right of
way and easement described in Section 1 to the City of Paducah.
SECTION 3. This ordinance shall be in full force and effect from and
after its adoption.
