HomeMy WebLinkAboutOrdinances Book 12, Page 363, No Ordinance Number363 AN ORDINANCE PROVIDING FOR THE EMPLOYMENT OF ATTORNEYS TO REPRESENT THE CITY` OF PADUCAH, KENTUCKY, IN LEGAL MATTERS; FIXING THE NUMBER TO BE EMPLOYED AND THE AMOUNT OF THEIR COMPENSATION; PRESCRIBING THE DUTIES OF SUCH ATTORNEYS; AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY I SECTION 1. The City of Paducah shall regularly employ three (3) attorneys as its representatives in legal matters, one to be designated as the Corporation Counsel and the other two as Assistants, one assistant to be assigned to the handling of civil matters for the city and the other to be assigned to the police court of the city. All shall be regularly admitted and practicing attorneys at law. They shall be appointed by the City Manager, shall perform their duties under his direction and control, and the employment of an attorney in any of said positions may be terminated at any time. SECTION 2. The Corporation Counsel shall attend all regular and special meetings of the Board of Commissioners, as well as any other meetings or conferenc, when his services are requested. He shall prepare all motions, resolutions and ordinances for the Board of Commissioners, all contracts in which the city is a party, and such other writings or documents as may b e required by the mayor and board of commissioners or by the City Manager. He shall have the responsibility of advising with and giving opinions to the Mayor, the members of the Board of Commissioners, the City Treasurer, and all other officials and employees of the city with the exception of those designated in Section 3 of this ordinance. Provided, however, in the absence of the Assistant Corporation Counsel assigned to the handling of civil matters, or when he is not available, the Corporation Counsel shall perform all of the duties imposed upon said assistant. It shall also be the duty of the Corporation Counsel to represent the city as attorney in each suit in the Cbrcuit Court, the Court of Appeals of Kentucky, and in the Federal Courts wherein the city is party complainant or a defendant, or a party in interest, if such suit involves the question as to the validity of any motion, ordinance, resolution or other measure adopted by the Mayor and the Board of Commissioners, including any other suit which is ordered to be filed by the Mayor and the Board of Commissioners, but he shall have the right to call upon and to be assisted by the Assistant Corporation Counsel or by the Special Counsel in the prosecution or the defense of any such suit. SECTION 3. The Assistant Corporation Counsel assigned to the handling of civil matters shall assist the Special Counsel in all litigation involving the acquisition of the electric utilities system of the Kentucky Utilities Company, as well as in other litigation where the Corporation Cpunsel or the Special Counsel may require assistance. He shall also have the responsibility of giving advices to the Building Inspector; the Chief of the Fire Department; the Chief of the Polic Department; the officials of the City Planning and Zoning Commission; the Board of Adjustment; The Police and Firemen's Pension Fund, and the Appointive Employees �n z, i. 1"°!DED 364 Pension Fund. In the event of the absence of the Corporation Counsel from the city, or when he is not available, said assistant shall perform all of the duties imposed upon the Corporation Counsel. SECTION 4. The Assistant Corporation Counsel assigned to the Police Court of the City of Paducah shall appear for the city in all cases in the Police Court, and shall prosecute or defend on behalf of the city all appeals from the decisions of said court, in which the city may be a party, or is in any same manner as the salaries of other employees of the city are paid. SECTION 6. The City Manager is authorized to provide such clerical and stenographical assistance at the City Hall as may be required by said attorneys for the efficient handling of legal matters for the city. SECTION 7. All ordinances and parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION 8. This ordinance shall be in full force and effect on and after April 16, 1951. The services of the Special Counsel may likewise be terminated by the City Manager at any time. SECTION 6. The monthly salaries of the attorneys employed by the City of Paducah shall be in amounts as follows: 57 VQ (1) Corporation Counsel $300.00 (2) Assistant, Corporation Counsel /Z" P-3` assigned to the handling of civil matters 200.00 SBO (3) Assistant Corporation Cpunsel assigned to Police Court 155.00 (4) Special Counsel 305.00 The salaries of attorneys shall be paid at the same time and in the same manner as the salaries of other employees of the city are paid. SECTION 6.
