HomeMy WebLinkAboutOrdinances Book 12, Page 357, No Ordinance NumberAN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING COMMISSION RESPECTING THE ZONING OF THE PROPERTY ON BOTH SIDES OF THIRTY-SIXTH STREET BETWEEN FREIDMAN AVENUE AND CENTRAL AVENUE AND ON THE EAST SIDE OF THIRTY- SIXTH STREET BETWEEN "THE BRANCH" AND PINES ROAD, ZONIM SAID PROPERTY FOR RESIDEN- TIAL PURPOSES, MAKING SAID PROPERTY SUBJECT TO CERTAIN RESTRICTIONS AND FIXING PENALTIES FOR VIOLATIONS OF SUCH RESTRICTIONS. BE IT ORDAINED BY THE BOARD OF COMhIISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the City Planning and Zoning Commission on April 20, 1951, entitled: "A RESOLUTION RESPECTING THE FINAL REPORT OF THE CITY PLANNING AND ZONING COMMISSION ON THE PROPOSED ZONING OF THE PROPERTY ON BOTH SIDES OF THIRTY-SIXTH STREET BETWEEN FREIDMAN AVENUE AND CENTRAL AVENUE AND ON THE EAST SIDE OF THIRTY-SIXTH STREET BETWEEN 'THE BRANCH+ AND PINES ROAD", be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That all property fronting on both sides of Thirty-sixth street between ]Freidman Avenue and Central Avenue and all property fronting on the east side of Thirty-sixth street between "The Branch" and Pines Road, be and it is hereby, zoned for residential purposes only and shall be subject to the following restrictions: (1) All lots in the property referred to above, shall be, and shall be known and described as, residential lots, to be used and maintained for residentia: purposes only, and no structure shall be erected, altered or placed on any such lot other than one detached single family dwelling, or two-family duplex apartment dwelling, not to exceed two stories in height and a private garage for not more tha 2 automobiles. (2) All residences shall front the streetsin the manner in which the lots are laid out. (3) The ground floor square foot area of any residential structure, exclus of one story porches -.and garages, shall not be less than 1000 square feet. (4) No noxious or offensive trade or activity shall be carried on upon any lot, nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood. (5) No trailer, basement, tent, shack, garage, barn or other outbuilding erected or placed on the said property shall at any time be used as a residence temporarily or permanently, nor shall any residence of a temporary character bepermitted. SECTION 3. Any property owner, tenant or other person who erects, constructs or reconstructs -any building in violation of, or contrary to, the provisions of thi ordinance, or who breaches or violates any provision of this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than x'10.00 nor more than $100.00 for each offense so committed, or the person so offending or so guilty of a violation of the provisions hereof, may, in addition to such fine,, be imprisoned not more than fifty (50) days at the 357 Q T M 0 C� 0 358 discretion of the Judge or Jury trying the case, and each day such offense is committed shall be deemed a separate offense and shall be subject to a separate penalty under the provisions hereof. SECTION 4. If any section or provision of this ordinance shall be found to be inoperative or ineffective for any cause, the invalidity of such section or provision shall not affect any other section or provision hereof, it being the purpose of this ordinance to make each and every section and provision hereof separable from all other sec tions and provisions so that if any section or provision shall be found to be invalid, the invalidity thereof shall not affect any other portion, section or provision hereof.
