HomeMy WebLinkAboutOrdinances Book 12, Page 333, No Ordinance Number33 AN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING CO1,UgIS3ION RESPECTING THE ZONING OF THE PROPERTY KNOW14 AS THE "CONRAD SCHMIDT PROPERTY", WHICH IS BOUNDED ON THE WEST BY "CTT STREET ANDD MISSISSIPPI STREET, ON THE SOUTH BY SEITZ STREET, ON THE EAST BY THE OLD NiAYFIELD ROAD AND ON THE NORTH BY THE NORTH LINE OF CONRAD SCHMIDT, ZONING SAID PROPERTY FOR RESIDENTIAL PURPOSES AND MAKING SAID PROPERTY SUBJECT TO CERTAIN RESTRICTIONS BE IT ORDAINED BY THE BOARD OF C0101ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the City Planning and Zoning Commission on March 23, 1951, entitled: "A RESOLUTION RESPECTING THE FINAL REPORT OF THE CITY PLANNING AND ZONING COI,;2_ISSION ON THE PROPOSED ZONING OF THE PROPERTY KNOWN: AS THE 'CONRAD SCH1,iIDT PROPERTY?, WHICH IS BOUNDED ON THE WEST BY TCT STREET AND MISSISSIPPI STREET, ON THE SOUTH BY SEITZ STREET, ON THE EAST BY THE OLD MAYFIELD ROAD AND ON THE NO3TH BY THE NORTH LINE OF CONRAD SCHMIDT", be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the property known as the "Conrad Schmidt Property", which is bounded on the west by "CTT street and Mississippi street, on the south by Seitz Street, on the east by the Old Mayfield Road and on the north by the north line of Conrad Schmidt, all as shown by a plat on file in the office of the City Clerk of the City of Paducah, Kentucky, be, and it is hereby, zoned for residentiali purposes only and shall be subject to the following restrictions: (1) All lots in the above mentioned tract shall be, and shall be known and described as, residential lots, to be used and maintained for residential purposes only, and no structure shall be erected, altered, placed or permitted to remain on any such lot other than one detached single- family dwelling not to exceed one and one-half (1`) stories in height and a private garage for not more than two (2) cars. (2) No building shall be erected on any residential building lot nearer than twenty-five (25) feet to the front lot line, nor nearer than five (5) feet to any side lot line. No separate garage or other outbuilding shall be located nearer than fifty- five (55) feet to the front lot line or nearer than five (5) feet to any side lot line. All residences shall front the streets in the manner in which the lots are laid out. (3) The ground floor square foot area of any residential structure, exclusive of one story porches and garages, shall not be less than Six Hundred Ninety-eight (698T square feet. (4) No noxious or offensive trade or activity shall be carried on upon any lot nor shall anything be done thereon which may be or become an annoyance or nuisance to the neighborhood. (5) No trailer, basement, tent, shack, garage, barn or other outbuilding erected or placed on the tract shall at any time be used as a residence temporarily or permanently, nor shall any residence of temporary character be permitted.11 SECTION! 3. Any property owner, tenant or other person who erects, con- structs-or or_-structs or reconstructs any building in violation of or contrary to the aforesaid provisions of this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than .;;10.00 nor more than .;'100.00 for each offense so committed and each day such offense is committed shall be deerred a separate offense and shall be subject to a separate penalty under the ?3 - provisions hereof, or the person so offending or so guilty of violation of the provisions hereof, may in addition to such fine be imprisoned not more than fifty (50) days at the discretion of the Judge or Jury trying the case. SECTION 4. If any section or provision of this ordinance shall be foun-! to be inoperative or ineffective for any cause, the invalidity of such section or provision shall not affect any other section or provision hereof, it being the purpose of this ordinance to make each and every section and provision hereof separable from all other sections and provisions so that if any section or provision shall be found tobe invalid, the invalidity thereof shall not affect an,,,- other nyother portion, section or provision hereof.
