HomeMy WebLinkAboutOrdinances Book 12, Page 324, No Ordinance NumberAN ORDINANCE PROVIDING FOR THE PURCHASE OF AN OPTION FOR A PERIOD OF THIRTY (30) DAYS UPON A LOT OR PARCEL OF LAND LOCATED AT THE NORTHWEST CORNER OF TWELFTH AND BURNETT STREETS IN PADUCAH, KENTUCKY, FOR USE AS A SITE FOR THE CON- STRUCTION OF A NEW FIRE STATION IF SAID OPTION SHALL BE EXERCISED; AND PRESCRIBIE THE TERMS AND CONDITIONS TO BE CONTAINED THEREIN BE IT ORDAINED BY THE BOARD OF COMi,ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah, Kentucky, by the payment to T. 0. Allen and his wife, Dessie Allen, of the sum of Twenty -Five Dollars (•.125.00), purchase from than and accept an option upon that certain lot -or parcel of land located at the northwest corner of Twelfth and Burnett Streets in Paducah, Kentucky, .for use as a site for the construction of a new fire station if said option shall be exercised, and said option shall be in words and figures as follows, to -wit: "That for and in consideration of the sum of Twenty-five Dollars (•;;25.00) cash in hand paid to the Seller (meaning T. 0. Allen and his wife, Dessie Allen) by the City (meaning the City of Paducah), the Sellers do hereby grant unto the City the option to purchase the hereinafter described lot or parcel of land at any time within a period of sixty (60) days after this date, and in the event said option shall be exercised in the manner provided herein, the Sellers hereby bind themselves and agree to sell and convey to the City by a good and sufficient deed with covenant of General "arranty, the fee simple title to that certain lot or parcel of land lying and being in the City of Paducah, County of McCracken and State of Kentucky, described as follows, to -wit: "Beginning at the northwest corner of the intersection of 12th and Burnett Streets; thence in a northerly direction and along the :vest property line of Burnett Street 129.4 feet; thence at right angles and in a westerly direction 134.68 feet to the line of a 15 foot alley; thence in a southerly direction and parallel with Burnett Street 138.75 feet to the north property line of 12th street; thence in an easterly direction and with the north property line of 12th Street 135 feet to the point of beginning." Being in all respects the same property conveyed to T. 0. Allen by deed dated February 8, 1945 and of record in Deed Book 230 page 508, in the office of the County Court Clerk of McCracken County, Kentucky. It is understood and agreed that the foregoing option may be exer- cised by the payment of the sum of Twenty-four Hundred and Seventy-five Dollars (;2,4755), in cash to the Seller at any time within a period of sixty (60) days from the date of this option, in which event the Seller shall convey to the City a good and marketable title to said property free and clear of all liens and encumbrances. If said option shall nnt hA exercised, the sum of Twenty-five Dollars (•;;25.00) paid as the consideration therefor shall be retained by the Sellers. The above described property shall be conveyed free andclear of the lien securing, the payment of any cite or state and county taxes which became due and payable up to and including those assessments due and ppryable in the year 1950, andthe City shall pay all such assessments which will be due and payable in the year 1951• IN TESTDIONY WHEREOF, the parties of the first part have hereunto subscribed their names this the day and date first above written."
