That upon the recommendation and request of the City Planning ® and 'Zoning Commission as shown by its final report embodied in a resolution adopted by it on March 16th, 1951, all of the property on the south side of Harrison street from 25th street to a point 150 feet east of 28th street for a depth of 163.25 feet; the north side of Harrison from 25th street to 28th street . a depth of 163.25 feet; and both sides of Clay street from 25th street, if extend, to 28th street for a depth of 163.25 feet is hereby declared to be a residential district within the meaning of the City Planning and Zoning Commission Law and to be used for residential purposes only; SECTION 2. All property within said area is subject to the following restrictions: (1) All lots in the above-mentioned tract shall be known and described as residential lots, used and maintained for residential purposes only and no structure shall be erected, altered, placed or permitted to remain on any residential building plot other than one detached single family or duplex dwelling not to exceed two stories in height and a private garage for not more than two cars. (2) No building shall be erected on any residential build- ing plot nearer than 30 feet to the front lot line, nor nearer than 5 feet to any side lot line. No separate garage or other outbuilding shall be located nearer than 125 feet to the front lot line or nearer than 5 feet to any side lot line, except that in case of the corner lots the garage shall be located no closer to the street property line than the side of the residence fronting Harrison or Clay streets. All residences shall front the streets in the manner in which the lots are subdivided. (3) No residential lot shall be resubdivided into building plots having less than 8162.5 sq. ft. of area or a width of less than. 50 feet each. (4) The ground floor square foot area of the residential structures, exclusive of one story porches and garages, shall t. in the case of a one story structure nor less than 720 square feet in the case of a 11 or 2 story structure. (5) No noxious or offensive trade or activity shall be carried on upon any lot nor shall anything be done thereon which may be or become an annoyance or nuisance to the neighborhood. (6) No trailer, basement, tent, shack, garage, barn or other putbuilding erected in the tract shall at any time be used as a residence temporarily or permanently, nor shall any residdnce of a temporary character be permitted, except that this section shall not Prevent guests or visitors of the residents of this area from occupying their own trailers for a period of not more than 30 days. 31/ SECTION 3; Any property owner, tenant or other person who erects, constructs or reconstructs any building in violation of or contrary to the aforesaid provisions of this ordinance, shall be deened guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than "10.00 nor more than :;;100.00 for each offense so committed and each day such offense is committed shall be deemed a separate offense and shall be subject to a separate penalty under the provisions hereof, or the person so offending or so guilty of violation of the provisions hereof, may in addition to such fine be imprisoned not more than fifty (50) days at the discretion of the Judge or Jury trying the case. SECTION y.
