HomeMy WebLinkAboutOrdinances Book 12, Page 303, No Ordinance Number303 AN ORDINANCE ACCEPTING THE BID OF THE UNITED STATES RUBBER COMPANY FOR THE SALE TO THE CITY OF PADUCAH OF 1200 FEET OF EUREKA MULTEX TWO PLY FIRE HOSE, AND 500 FEET OF VULCAN D. J. FIRE HOSE; AND AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT FOR THE PURCHASE OF SAID HOSE WHEREAS, on January 25, 1951, the City Manager received bids for the purchase of 1200 feet of 2i inch fire hose, and 500 feet of 1� inch fire hose, receiving on said date the bids of Hank Brothers, local sales agent for the United States Rubber Company, the Hannan Supply Company, and the Bogie Equipment Company',: and WHEREAS, the bid of the United States Rubber Company submitted by Hank Brothers was the lowest and best bid received; NOW THEREFORE,BEIT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAI KENTUCKY: SECTION 1. That the City of Paducah accept the bid of the United Mates Rubber Company in the amount of $2,763 for the sale to said city of 1200 feet of Eureka Multex two-ply fire hose, and 500 feet of Vulcan D.J. fire hose, and the City Manager is hereby authorized and empowered, for and on behalfo.f the City of Paducah, to enter into a contract with the United States Rubber Company for the purchase of said fire hose, said contract to be in words and figures, to -wit; "THIS CONTRACT OF SALE made and entered into this the day of March, 1951, by and between the United States Rubber Company, a corporation of the State of , (hereinafter referred to as the Seller) party of the First part, and the City of Paducah, a municipal corporation of the second class of the State of Kentucky, (hereinafter referred to as the Buyer), p arty of the second part; WITNESSETH: That for and in consideration of the sum of $2,763, subject to the discount hereinafter provided, the Seller agrees to sell and deliver to the buyer 1200 feet of 2 z" Multex two-ply multiple woven fire hose and 500 feet of l 1/2" Vulcan double jacket fire hose, and the Buyer agrees to purchase said fire hpse at, that price. It is further mutually covenanted and agreed between the parties hereto that: (1) The purchase price .for the aforesaid quantity of fire hose shall be paid in cash. Provided however, if said hose shall be delivered to and accepted by the Buyer within a period of thirty days from the date of this contract-, the Buyer shall be entitled to a discount of 2'0 on the purchase price. (2) The fire hose shall be coupled complete in fifty foot sections and delivered freight prepaid. (3) The fire hose shall be subjected to such treatment as will prevent mildew and rot; it shall be guaranteed to be free from defects in manufacture and material on delivery. Any hose which, on delivery, faile to withstand 400 pounds of test pressure will be considered defective and will be replaced. 304 free of charge, upon return of such defective lengths. But the Seller shall not be responsible for such failure except for such replacement, and it makes no other guaranty except as herein provided. It is understood that the hose furnished under this contract shall receive the proper care to protect if from injury. (4) The Seller will only be excused for failure or delay in delivery as a result of wars, fires, labot shortage or labor troubles, transportation difficulties, governmental regulations, restrictions, productions or shipments, shortage of material, or any cause or causes of like or different nature which are beyond the Sellers reasonable control. (5) Seller shall execute and deliver to the Buyer a bond by the terms of which it shall obligate itself, together with a surety approved by the City Manager, to make delivery of the aforesaid hose within a period of sixty days from the date of this contract, and upon its failure so to do, shall pay as liquidated damages the sum of $270.00 for the breach of said contract by failing to deliver within that period.
