AN ORDINANCE ACCEPTING THE BID OF CURTIS WILKERSON FOR THE SALE TO THE CITY OF
PADUCAH OF #9 AND $10 LIMESTONE, KENTUCKY STATE HIGHWAY SPECIFICATIONS, TO BE USED
BY SAID CITY DURING THE YEAR 1951, AND AUTHORIZING THE CITY MANAGER TO ENTER INTO
AND EXECUTE A CONTRACT FOR THE PURCHASE OF SAID MATERIAL; AND PRESCRIBING THE
TERMS AND CONDITIONS UNDER WHICH SAID PURCHASES SHALL BE MADE
WHEREAS, the City Manager has advertised for bids for limestone as required
by the resolution adopted by the Board of Commissioners on January 30, 1951, and
having received bids of Gabe McCandless and Curtis Wilkerwon; and
WHEREAS, Curtis Wilkerson having submitted the lowest and best bid;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That the bid of Curtis Wilkerson for the sale to the City of Paducah
of No. 9 and No. 10 Limestone, Kentucky State Highway Specifications, required
by the City of Paducah during the year 1951, be accepted and that the City Manager
is hereby authorized to enter into and execute a contract for the purchase, upon
the order of said city, of all No. 9 and No. 10 Limestone, Kentucky State Highway
Specifications, to be used during the year 1951, said contract to contain the
following terms, conditions and covenants:
"The seller, (meaning Curtis Wilkerson) hereby agrees to sell and
deliver to the City upon its order No. 9 and No. 10 Limestone,
Kentucky State Highway Specifications, required in all repair
and resurfacing work of city streets during the remainder of the
year 1951, at the price and upon the terms set forth in his bid
as follows:
"No 9 and No. 10 Limestone f.o.b. 6th and
Campbell Streets, for the price of $2.35 per
ton, for the year 1951. Delivery request must
be made twenty-four hours in afvance."
The Seller further agrees that:
1. No. 9 and No. 10 Limestone, Kentucky State Highway Specifications,
is to be delivered f.o.b. 6th and Campbell Streets or spot designated
by Street Superintendent.
2. Said limestone to be weighed by Weighmaster at the City Scales
at no charge to the Seller.
3. Material to be subject to approval or rejection by the Street
Superintendent.
4. Said Limestone to be delivered within twenty-four hours in
amounts stipulated by Street Superintendent.
5. The Seller agrees that the price herein quoted i& guaranteed
as maximum delivered price for any such material supplied during
the year 1951, but that in the event of a reduction in the price
of said limestone at the quarry, the city shall be given the benefit
of the reduction."

SECTION 2. This ordinance shall be introduced at a regular meeting
of the Board of Commissioners and remain on file at least one (1) week for
public inspection in the completed form in which it shall be put upon its
final passage and if adopted it shall be in full force and effect ten (10)
days thereafter.
