AN ORDINANCE RELATING TO AND FUR9HER REGULATING 7IiE GRANTING OF LICENSES FORS
SELLING, DISPENSING AND DEALING IN ALCOHOLIC AND MALT BEVERAGES IN THE CITY OF
PADUCAH, KENTUCKY; PRESCRIBING THE ELIGIBILITY OF APPLICANTS FOR LICENSE; LIMITING

BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY (F PADUCAH, KENTUC
SECTION 1. It shall be unlawful for any person or partnership to hold in
the City of Paducah, Kentucky, an alcoholic or malt beverage license of any kind
if such person or all of the members of such partnership firm are not citizens of
the United States, or have not been bona fide residents of the Commonwealth of
Kentucky for at least one year next preceding the date on which the application
for such license is made.
It shall be unlawful for any corporation to hold in the City of Paducah,
Kentucky, an alcoholic or malt beverage license if as much as 25a of the capital
stock of such corporation is owned by any person or persons who have not been bona
residents of the State of Kentucky for at least one year next preceding the date
on which the application for such license is made.

ys iu b„ ity of Paducah of spirituous or vinous liquors at retail by the glass for consum
q tion on the premises more than one such license for every 2500 of the inhabitants
of McCracken County, Kentucky, according to the enumeration of the population
vv thereof as now established by the 1950 census of the United States, or according
to such enumeration of the population as may hereafter be fixed by ordinance upon
the recommendation of the Paducah Association of Commerce.
SECTION 3. There shall not be issued for the privilege of selling in the
City of Paducah of spirituous or vinous liquors at retail by the package for con-
sumption off the licensed premises more than one such license for every 1500 of thi
population of McCracken County as fixed and determined under Section 2 of this
ordinance.
SEC TION 4. The rights and privileges of those now holding licenses for the
sale of spirituous or vinous liquors, either for consumption by the glass on the
premises or in packages for consumption off of the premises, and the rights abd
privileges of those to whom such licenses are transferred with the approval of
the City Alcoholic Beverage flfiministrator and the Alcoholic Beverage Control Board
of the State of Kentucky, shall not be affected by the provisions of this ordinanc
but in the euent any license shall hereafter be revoked, surrendered or not re
no new license shall be issued if the number of licenses shall then exceed the
limits as to the number as provided in Sections 1 and 2 of this ordinance.

SECTION 5. Any person who, by himself or acting through another, shall violate
any of the provisions of this ordinance, shall upon conviction be fined not less
than Fifty (;'50.00) Dollars nor more than One Hundred (:?;100.00) Dollars, or con-
fined in the City Jail not less than ton (10) days nor more than thirty (30) days,
or both so fined and imprisoned; provided, that in case the offender be a corpor-
ation, joint stock company, association or fiduciary, then the principal officer
and/or the officer or officers responsible for such violation may be punished by
such imprisonment.
SECTION 6. If any section, part of section, sentence, clause or phrase of this
ordinance shall be held to be unconstitutional or invalid, the remaining provisions
hereof shall nevertheless remain in full force and effect.
SECTION T. All ordinances and parts of ordinances in conflict herewith are, to
the extent of such conflict, hereby repealed.
SECTIONS. This ordinance shall be in full force and effect from and after its
adoption.
