AN ORDINANCE DECLARING THE NEED FOR AN AIR POLLUTION CONTROL DISTRICT TO

FUNCTION UNDER SENATE BILL NO. 147 ENACTED BY THE GENERAL ASSEMBLY OF THE COM?4ON47EAL,TH
OF KENTUCKY AT ITS 1952 SESSION i
WHEREAS, the General Assembly of the Commonwealth of Kentucky at its 1952
Session enacted an Act known as Senate Bill No. 147 providing for the creation of
an Air pollution Control District in any county containing a city of the second
class, and
WHEREAS, the Fiscal Court of McCracken County, Kentucky has heretofore adopted

a resolution declaring the need for such Air Pollution Control District to function;

and
WHEREAS, on August 21, 1953, the Board of'Commissioners of the City of Paducak'
Kentucky adopted a resolution authorizing the Mayor and City Clerk to advertise the
time and place of a public hearing to determine whether or not there is need for
such a district, and
WHEREAS, such advertisement was published in the Sun -Democrat on August 27,
1953 ordering such public hearing to be held in the Commission Chamber of the City
Hall in Paducah, Kentucky on the 29th day of September, 1953 at 7:30 P.M., and
WHEREAS, such hearing was duly held on said date, and
WHEREAS, from the evidence received at such public hearing it appears:
(1) ' That the air within the City of Paducah, Kentucky, is so polluted with
air contaminants as to be injurious to health, and an obstruction to the free use
of property, and offensive to the senses of a considerable number of persons so as
interfere with the comfortable enjoyment of life or property.
(2) And further that it is not practical to rely upon the enactment or
enforcement of local ordinances to prevent or control the emission of smoke, fumes
or other substances which cause or contribute to such pollution, because such
ordinances could not control same as well as the provisions of the aforesaid Act.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY
OF PADUCAH, KENTUCKY:
SECTION 1. That there is a need for an Air Pollution Control District
to function under the terms and provisions of Senate Bill No. 147 enacted by the
General Assembly of the Commonwealth of Kentucky at its 1952 Session.
SECTION 2. This ordinance shall be in full force and effect from and
after its adoption.
