AN ORDINANCE` ACCEPTING THE BID OF WESTINGHOUSE ELECTRIC CORPORATION IN THE
AMOUNT OF $4,662.00 FOR ONE LOT OF INDOOR TYPE METAL -ENCLOSED SWITCHGEAR EQUIP-
MENT FOR PUMPING EQUIPMENT FOR DRAINAGE PUMP STATION #1 IN'STORM SEWER PROJECT No.l
KY 15 -CF -8 IN THE CITY 01' PADUCAH, KENTUCKY; PROVIDING THAT THE MAYOR EXECUTE A CON-
TRACT ON BEHALF' OF THE CITY OF PADUCAH WITH WESTINGHOUSE ELECTRIC CORPORATION FOR
SAID EQUIPMENT AND PROVIDING THE TERMS AND CONDITIONS OF SAID CONTRACT; PROVIDING
THAT SAID ACCEPTANCE OF SAID BID AND CONTRACT FOR SAID EQUIPMENT BE CONDITIONED
UPON THE APPROVAL AND ACCEPTANCE THEREOF BY THE HOUSING AND HOME FINANCE AGENCY
OF THE UNITED STATES OF AMERICA
WHEREAS, the City of Paducah, Kentucky advertised for bids for one lot of
indoor type metal -enclosed switchgear equipment for pumping equipment for
Drainage Pump Station No. 1 in Storm Sewer Project No. KY 15 -CF -8 in Paducah,
Kentucky, and
WHEREAS, bids were submitted by contractors on said equipment in accordance
with the "Notice to Bidders, Instructions to Bidders, Proposal Form, -Bond Form,
Contract Agreement Form, General"Conditions, Special Conditions and Specification
for Storm Sewer" which was propared by Black & Veatch, Consulting Engineers, and
WHEREAS, the lowest bid for said equipment was in the amount of $4,662.00
and was submitted by Westinghouse Electric Corporation, and
WHEREAS, it is believed said bid should be accepted by the City of Paducah
if it is approved by the Housing and Home'Fina.nce Agency of the United States of
America.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah, subject to the conditions herein set
out, approve and accept the bid of Westinghouse Electric Corporation in the
amount of $4,662.00 for one lot of indoor type metal -enclosed switchgear
equipment, including Type DB -25 Deiom Circuit Breaker Units for,pumping equip-
ment for Drainage Pump Station No. l.in Storm Sewer Project No. KY -15 -CF -8 in
Paducah, Kentucky. Approfal.and acceptance of said bid is subject.to all the
terms and conditions contained in the document on whizhh said bidder based his
bid on said work, this document having been prepared by Black & Veatch, Consultir
Engineers of Kansas city, Missouri, and entitled: "NOTICE TO BIDDERS,
INSTRUCTIONS TO BIDDERS, PROPOSAL FORM, BOND FORM, CONTRACT AGREEMENT FORM,
GENERAL CONDITIONS, SPECIAL CONDITIONS AND SPECIFICATIONS.
SECTION 2. Acceptance of the bid of Westinghouse Electric Corporation and
of the contract as set out in Section 1 herein shall be conditioned upon the
final approval of the bid of said contractor and the authority to the City to ent
into a contract therefor from the HHFA of the United States of America and until
said approval and authority is given and received neither the City nor the
Contractor will be obligated except that each will be obligated to comply with
the directions of said governmental agency and the decision of said agency

shall be binding upon them. If final approval for the entire work by said
contractor is granted by said governmental agency it is agreed that the parties
will properly execute a contract or contracts cont$ining all the terms of said
Contractorts bid and the said contract shall be in the form of the contract in
Black & Veatch's "Notice to Contractors, Instructions to Bidders, Proposal Form,
Bond Form, Contract Agreement Form, General Conditions, Special Conditions and
Specifications for Storm Sewers", and shall contain all the terms, specifications
and conditions thereof subject to such changes as may be required by the HHFA.
SECTION 3. It is further provided that said bid is accepted and said
contract is authorized as herein provided subject to payment therefor from grants
of money from the HHFA and that said Contractor will be paid for'said work from
funds received from said grant and the City of Paducah shall in no wise be obligate
under said contract for any payments out of any other revenues.
SECTION 4. The Mayor of the City of Paducah is hereby authorized
tm execute a contract, for and on behalf of the City of Paducah, with Westinghouse
Electric Corporation, said contract to contain all of the terms and conditions of
this ordinance and such other terms and conditions as provided for in the bid of
Westinghouse Electric Corporation.
SECTION 5.- This ordinance shall -be introduced at a regular meeting of
the Board of Commissioners of the City of Paducah, Kentucky, and remain on file
for at least one (1) rieek for public inspection in the completed form in which it
shall be put upon its final passage, but it being necessary for the public health
and safety of the City of Padfacah, Kentucky that said equipment be installed as
soom as possible to complete the aforesaid storm sewer project, an emergency
is hereby declared to•exist and this ordinance shall be'in full force and effect
from and after its adoption.
