HomeMy WebLinkAboutOrdinances Book 12, Page 1166, No Ordinance Number1166 j AN ORDINANCE ACCEPTING THE BID OF THE SOUTHLAND COMPANY FOR SALE TO THE CITY OF PADUCAH OF MC -0, MC -1, MC -3 AND RC -3 LIQUID ASPHALT TO BE USED BY THE CITY DURING THE YEAR 1953, AND AUTHORIZING THE CITY MANAGER TO ENTER INTO AND EXECUTE A CONTRACT FOR THE PURCHASE OF SAID MATERIALS, AND PRESCRIBING THE TERMS AND CONDI2IONS UNDER WHICH SAID PURCHASES SHALL BE MADE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1.That the bid of the Southland Company for sale to the City of Paducah of all MC -O, MC -1, MC -3 and RC -3 Liquid Asphalt required by the city of Paducah during the year 1953 be accepted, and the City Manager is hereby authorized to enter into and execute a contract for the purchase upon the order of said city of all asphalt bo be used during the year 1953, said contract to contain the following terms, conditions and covenants: The Company hereby agrees to sell and deliver to the city upon its order the MC -0-1-3 and RC -3 Liquid Asphalt required in all repair and construct work during the remainder of the year 1953 at the prices and upon the terms set forth in said Company's bid as follows: "In compliance with your request for Liquid Asphalt bids on MC -0, MC -1, MC-3,and RC -3, we Vote a delivered price.of .1050 per gallon. This is a firm bid for your 1953 asphalt requirements (approximately 20 to 30 -car- loads.) "Our asphaltic material meets Kentucky Highway Speci- fications. We will ship our material in 8 000 and 10,000 gallon insulated tank cars, with steam coiis and will make delivery within seven (7) days. "Our terms are 1% ten (10) days - 30 days net." In consideration of the agreement of the city to purchase from the all of the aforesaid grades of asphalt required during the remainder of the year 1953, the Company agrees that the prices for said asphalt shall not exceed the hereinabove provided, that in the event of a general advance in the retail price of asphalt during the aforesaid period the Company's obligation to sell and deliver asphalt at the aforesaid prices shall remain and continue in full force and effect, but in the event of a general decline in the price of said products the city will be given the benefit of the reduction in price. Prices quoted shall be fob 6th & Campbell Streets, Padudah, Kentucky. It is further provided that the Seller shall execute a Performance Bond in the amount of ;2,500 to the City of Paducah with good and sufficient surety company licensed to do business in the State of Kentucky for the performance of the contract. SECTION 2.
