AN ORDINANCE AiPENDING SECTION 1 OF ARTICLE III, ARTICLE IV, SECTIONS
1, 2 & 3 OF ARTICLE V, SECTIONS 2 & 4 OF ARTICLE VI, SECTION 2 OF ARTICLE VII
AND AR'TICLE'XII OF AN ORDINANCE ENTITLED: "AN ORDINANCE PROVIDING FOR A REFUSE
COLLECTION SERVICE FOR THE CITY OF PADUCAH; PRESCRIBING RULES AND REGULATIONS
GOVERNING SANITATION AND THE COLLECTION AND DISPOSAL OF REFUSE; PRESCRIBING
CHARGES FOR SAID REFUSE COLLECTION SERVICE AND THE i-IETHOD OF FINANCING SAID SERVICE
AND PRESCRIBING PENALTIES FOR THE VIOLATION OF SAID ORDINANCE", WHICH WAS ADOPTED
BY THE BOARD OF COI-EIISSIONERS ON DECEMBER 16, 1952.
BE IT ORDAINED BY THE BOARD OF CO'411ISSIONERS OF THE CI^lY OF PADUCAH,
KENTUCKY:
SECTION 1. That Section 1 of Article III, Article IV, Sections 1, 2 & 3
of Article V, Sections 2 & 4 of Article VI, Section 2 of Article VII and Article
XII of an ordinance containing the title quoted above, which was adopted by the
Board of Commissioners on December 16, 1952, be, and the same are hereby amended
and reordained so that said Sections and Articles as amended and reordained shall
read as follows:
"Article III Refuse Collection Service
Section 1. Inaikguration and Frequency of Collection: Refuse
Collection Service shall be provided to all households and business
places in the City of Paducah at a frequency of once a week
commencing the week beginning February 1, 1953, provided that the
regulations set forth herein governing the types and use of
containers and place of set out are adhered to.
"Article IV Adfitional Refuse Collection Service
Section 1. Establishment: Additional Refuse Collection Service,
as defined herein, shall be provided to households and business places
on request to the extant feasible in the judgment of the Director
of the Department of Public Works. Additional Refuse Collection
service for which request has been made shall not be provided by the
City unless it can be clearly demonstrated that the charge made
shall fully cover the cost to the City for same.
SEction 2. Set Out and Frequency of Pickup: In all instances in
which Additional Refuse Collection Service is provided, -the place
of set -out and frequency of pick-up shall be determined by mutual
agreement between the City and the party receiving said service,
provided that in the event no reasonable agreement can be reached,
the City reserves the right to so specify.
Section 3. Dempster Containers: The City Commission shall determine
the number of special containers of varying volumetric capacity
of the type manufactured by Dempster Brothers, Inc., which the City
shall own and shall maintain as part of the Cityts Additional nefuse
Collection Service system. The Cuty reserves the right to determine
where said special containers shall be located and the manner in
which they shall be used.
SECTION 4. Records and Exceptional Cases: The City I•ianager shall
be responsible for maintaining a record of the amount of service
rendered to and the charge imposed on each household or business
place where Additional Refuse Collection Service is provided.
In the event that the schedule of charges set forth in Article V,
Section 2 is not deemed applicable or suitable due to the atypical
nature of the service requested, the City Manager may designate
such a request as an Exceptional Case and may negotiate an agreement
for a special charge for such service, provided that each such
agreement negotiated shall be submitted to the Board of Commissioners
for review within 30 days from the time said agreement was entered
into, and provided further, that said agreement shall continue to
remain in effect unless the Board of Commissioners shall cancel same.
ARTICLE V Financing
Section 1. Refuse Collection Service: There is hereby levied
a refuse collection service charge of eighty cents (80¢) per
month on each household and each business place in the City of
Paducah for the purpose of increasing the revenues of the General
Fund out of which shall be met the costs of providing Refuse
Collection Service, provided that households of which the lawful
head is unable to afford said charge, as certified by the Cityts
duly appointed Social Worker, shall be exempt from said charge.
Section 2. Additional Refuse Collection Service: For Additional
Refuse Collection Service there shall be levied a charge which,
except for Exceptional Cases referred to in Section 4 of Article
IV, shall be based on the following schedule of charges:

SECTION 3. Method of Billinr_; To the extent feasible, charges
for. Refuse Collection Service shall be Billed monthly as a
separate item on the water bill sent out monthly by the Paducah
?later :9orks and said charge so billed shall be payable monthly
at the office of the Paducah i7ater IJorks in the same manner
and within the same penalty -free period as required for payment
of charges for water service. The water customer in whose
name the water meter account is carried shall ge held respon-
sible for payment of the full amount of the Refuse Collection
Service charges billed, which total amount shall be based on
the number of households and/or business places served by said
water meter. Due to the daily, cycular billing system used
by the Paducah .later Works, charges for Refuse Collection Service
may be billed at the beginning, during, or at the end of the
monthly period in which Refuse Collection Service is rendered,
and the first billing period corresponding with the first period
of service shall be the month of February, 1953, and thereafter
in monthly cycles. In instances when it is not feasible or
possible to utilize the water bill in notifying households or
business places of Refuse Collection Service charges payable,
bills shall be prepared at and dispatched from the City Hall,
and shall be payable at the City Hall within ten days after
date of rendering.

Article VI Sanitary Regulations
SEC^lION 2. Disposal of Refuse: No refuse shall be deposited or
dumped at any location in the City of Paducah on private or public
property unless the City Manager has publicly declared or privately
certified in writing that such location is a suitable location
for said deposit or dumping. Said declaration or certification
may be withdrawn at any time when the City -County Sanitarium or
the City Manager determines that said location is unsuitable for
such deposit or dumping.
SECTION 4. Private Collectors:
a. No refuse in the City of Paducah shall be collected
transported or disposed of by any person, firm or corporation,
other than the City of Paducah, on a commercial, contract or
agreement basis unless and until such agency has previously
obtained a Smitten permit to do so from the City and has paid a
permit fee of two dollars (u2.00) monthly in advance to the City
of Paducah. Such permits may be issued to cover periods not to
exceed six (6) months and shall not be transferable, and the
permit fee shall not be refundable. Applications for such permits
shall be presented to the City Manager in smiting and shall
specify from what place or places the applicant desires to collect
refuse, and no permit shall be issued without approval of the
Board of Commissioners. Such permit may be revoked at any time
when, in the opinion of said Board, the person granted such permit
has failed to operate in a cleanly, sanitary and responsible
manner.
b. No wastes other than refuse, as defined herein,
shall be collected, transported or disposed of in the City of
Paducah except in a sanitary and sightly manner.
c. Ido provision in this Section shall be construed
to prevent or penalize any individual or business place from
transporting or disposing of refuse produced by his household or
business place provided that said refuse is transported in a
sanitgry manner and is disposed of at a location declared or
certified by the City Manager as suitable, provided that disposal
by such means shall not exempt said individual or business place
from the obliEation to pay the Refuse Collection Service Charge
provided for under Article V hereof.

SECTION 5. Control of Scavengers: No person shall rifle, pilfer,
dig into or in any manner disturb containers containing refuse
which have been set out at households or business places prior to
collection.
Article VII Disposal Locations
SECTION 2. Users and Dumping Fees: Iiouseholds disposing of
their own refuse at a City dumping place shall be charged a fee
of twenty cents (200_ for each dumping. Business places or households
disposing of their ovm refuse shall be charged a dumping fee of fifty
cents (500) per truck load. Private collectors who are collecting
refuse under permit shall be charged fifty cents (500)'per load for
refuse and one dollar (}1.00) per load for non -refuse. Persons
disposing of waste other than refuse, as defined in this ordinance,
may utilize a City -maintained dumping place for a charge of one
dollar (;x1.00) per load.
Article III Effective Date:" The terms and provisions of this ordinance
shall become effective on February 1, 1953, provided that, the
provisions of sub -section 4a of Article VI shall not take effect
until April 1, 1953•"
SECTION 2. All ordinances and parts of ordinances in conflict
herewith are, to the extent of such conflict, hereby repealed.
SECTION 3. This ordinance shall be in full force and effect
from and after its adoption/
