ZONING COPI-ISSION RESPECTING THE SUBDIVISION OF PROPERTY LOCATED ON 32ND STREET,
PINES ROAD AND RUCKER AVENUE, APPROVING THE PLAT OF SAID SUBDIVISION AND SUB-
DIVIDING SAID PROPERTY
BE IT ORDAINED BY THE BOARD OF COP1ISSIONERS OF THE CITY OF PADUCAH,
KENTUCKY:
SECTION 1. That a resolution adopted by the Paducah Planning and Zoning
Commission on March 12, 1953, entitled: "A RESOLUTION CONSTITUTING THE FINAL
REPORT OF THE PADUCAH PLANNING AND ZOI'ITIG C014MISSION ON THE PROPOSED SUBDIVISION
OF PROPERTY LOCATED ON 301D STREET, PI11ES ROAD AND RUCKER AVENUE", be approved
as the'final report of said Commission respecting the matters therein set forth.
SECTION 2. That the subdivision of property located in the City of Paducah
and described as follows:
Beginning at the northwest corner of Pines Road and
North 32nd Street; thence with the west property line
of North 32nd Street north 46 degrees 45 minutes west
237.$ feet to a point in said line; thence south
42 degrees 43 minutes 42 seconds west 775 feet to•a
point; thence south 46 degrees 45 minutes east 237.8
feet to'a point in the north line of Pines Road; thence
with the north line of Pines Road North 42 degrees 43
minutes 42 seconds east to the point of beginning.
as shown on the plat prepared by Elmer Y. Hollis and entitled "River Oaks Addition
No. One", which said plat has been approved by the Paducah Planning and Zoning
Commission and bears the signatures and acknowledgements of the Chairman of said
Commission and the City Engineer, dated March 12, 1953, be, and it is hereby
approved, and said property is hereby declared to be subdivided as shown on said
plat.
That strict compliance with the provisions of an ordinance entitled: "AN
ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING COlk—MISSION
ESTABLISHING RULES AND REGULATIONS RELATING TO THE LAYING OUT, SUBDIVIDING AND
PLATTING OF LANDS MTHIN THE CITY OF PADUCAH AND ZdITHIN THREE MILES OF THE CITY
LIMITS, ADOPTING SAID RULES AND REGULATIONS RECO13FLENDED IPI THE FINAL REPORT OF THE
CITY PLANNING AND ZONING COD ISSION, AND PRESCRIBING THE PENALTY TO BE IPIPOSED FOR
THE VIOLATION OF THE RULES AND REGULATIONS SET FORTH IN A RESOLUTION ADOPTED BY THE
CITY PLANNIPiG AND ZONING CODMI SSION ON MARCH 26, 1945", which was adopted by the
Board of Commissioners on March 27, 1945, would impose an undue hardship upon the
owner of said property, and such provisions, to the extent hereinafter indicated,
are hereby waived.
That in lieu of placing markers and monuments on said property and certifying
such placement on said plat, the surveyor and the owner of said property may certify
on said plat that within a period of 15 months from the adoption of this ordinance
they will place said markers and monuments as shown on said plat, provided, however
that as a condition to this authorization said ormer shall furnish bond with good
and sufficient surety in the amount of sr1,000.00, which said bond shall be in
the form similar in substance to the one heretofore furnished in cormnection
with the subdivision of "Cornell Place,' pursuant to ordinance of record in
Ordinance Book 12, page 351, and shall be released upon cwrtification of a
surveyor hired by the developer that the markers and monuments have been
installed as specified on said plat, which ce=tification shall be made to and
approved by the Paducah Planning and Zoning Commission prior to such release.
SECTS That if any section, paragraph or provision of this ordinance
shall be found to be inoperative, ineffective or invalid for any cause, the
deficiency or invalidity of such section, paragraph or provision shall not
affect any other section, paragraph or provision hereof, it being the purpose
and intent of this ordinance to make each and every section, paragraph and
provision hereof separable from all other sections, paragraphs and provisions.
SECTION 4. Said plat shall not be released for recording until the bond
referred to in Section 2 hereof has been approved by this Board.
SECTION 5. This ordinance shall be in full force and effect from and
after the date on which the aforesaid plat it lodged for record in the office
of the Clerk of the McCracken County Court.
