That the lease executed by the City of Paducah to the 1,1unicipal Service and Supply Company on the 26th day of July, 1950, said lease providing for the rental of the dump on north 6th street in Paducah, Kentucky, for use by the Municipal 6ervice and Supply Company, as a site for the collection and disposal of garbage and rubbish be, and the same is hereby amended, and the Mayor and City Clerk are hereby authorized and empowered, for and on behalf of the City of Paducah, to enter into and execute an amendment of said lease which shall be in words and figures as follows, to -crit: "This Amended Lease, made and entered into this the day of August, 1950, by and between the City of Paducah, a municipal corporation of the second class of the State of Kentucky, (hereinafter referred to as the Tcity? ), party of the first part, and the Municipal Service and Supply Company, a corporation created, organized and existing under the laws of the Commonwealth of Kentucky, having its principal office and place of business in the City of Louisville, Jefferson County, Kentucky, (hereinafter referred to as the 'Lessee I), party of the second part; !W I T IT E S S E T H : '.WHEREAS, on the 26th day of July, 1950, the City leased to the Lessee a tract of land on North Sixth Street in the City of Paducah for use as a site for the disposal of gar- bage and rubbish, and it was provided that the Lessee should render certain services to the City of Paducah without charge in consideration of his right and privilege to use said property as a dumping ground for the disposal of garbage and rubbish for a period of one year and four months beginning September 1, 1950; and WHEREAS, in addition to the services which the Lessee agreed to perform for the city without charge it was also intended by the parties to said Lease that he would dispose of all rubbish which accumulates on and is collected from all rublic parks of the city; 109 NMI THEREFORE, in consideration of the promises and agree- ments contained in the aforesaid original lease, the Lessee here- by binds himself and agrees to collect all city garbage without charge during the aforesaid period, includin; garbage collected from the jail at the City Hall, from the kitchel at the fire department, from all cafeterias and eating places in the public schools of the city; to dispose of all city garbage, rubbish, street cleanings, trees and tree limbs, including rubbish collected at all public parks in the city and to dispose of the same for the period provided in said original lease, and to dispose of all of such garbage and rubbish without charge in the manner provided in Clause III of said original lease. It is further understood and agreed that, except as modified by the provisions of this amended lease, all of the terms, conditions and agreements contained in the aforesaid original lease of July 26, 1950 shall remain and continue in full force and effect.
