HomeMy WebLinkAboutOrdinances Book 11, Page 922, No Ordinance Number922 i AN ORDINANCE AUTHORIZING TIME CANCELLATION OF THE CONTRACT OF EMPLOYMENT OF COPELAND AND KEEL, ATTORNEYS, FOR THE COLLECTION OF DELINQUENT TAXES AND PUELIC IMPROVEMENT ASSESSMENTS OWING THE CITY OF PADUCAH AND PROVIDING, FOR THE ACCEPTANCE OF A RELEASE BY THE CITY OF PADUCAH FROM ALL LIABILITY UNDER SAID CONTRACT WHEREAS, pursuant to an ordinance adopted by the Board Of Commissioners on June 30, 1949, the City of Paducah entered into a contract for the employment of Copeland and Keel, Attorneys, to prosecute to conclusion eighty-three suits then pending and which were to be instituted by the city for the enforcement of liens securing the payment of ad valorem taxes and public improve- ment assessments; and WHEREAS, by reason of the difficulties encountered by said attorneys in the preparation and prosecution of said suits, they have been unable to perform the services required under said contract for the closing of said suits within the time specified therein and it is their desire to be released from the performance of said contract; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Contract which the City of Paducah entered into vith A. Roy Copeland and Rudy Keel, Attorneys, on July 3, 1948, ;aid contract providing for the employment of said attorneys to )rosecute eighty-three suits then pending and which were to be _nstituted by the city for tFe enforcement of liens securing the )ayment of ad valorem taxes and public improvement assessments )e cancelled upon the condition that said Attorneys execute and leliver to the City of Paducah a release which shall be in words nd figures as follows, to -wit: "KNOW ALL YEN BY THESE PRESENTS: That we, A. Roy Copeland and Rudy Keel, attorneys engaged in the practice of law under the firm name of Copeland & Keel, for and in consideration of the sum of One Hundred Eighty-five ($185.00) Dollars, paid to us by the City of Paducah, Kentucky, the receipt of which is hereby acknowledged, do hereby forever release and discharge the City of Paducah of and from all claims, demands, actions and causes of action which we have upon or against it under a certain contract of employ- ment which we entered into w ith the City of Paducah on the 3rd day of July, 1948, which contract pro- vided for our employment as attorneys to prosecute 923 to conclusion eighty-three suits then pending and which were to be filed by us for the enforcement of liens securing the payment of ad valorem taxes and public improvement assessments. "We hereby agree to the cancellation of the aforesaid contract and accept the sum of One Hundred Eighty-five ($185.00) Dollars in full payment and satisfaction of the amount owing to us for services rendered in. the prosecution of the suits referred to in the aforesaid contract.
