HomeMy WebLinkAboutOrdinances Book 11, Page 83, No Ordinance NumberAN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING COMMISSION TO AMEND SECTION 2 OF AN ORDINANCE ENTITIED: "AN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING COh4.'.ISSION PROVIDING FOR THE ZONING OF CERTAIN PROPERTY ON BOTH SIDES OF KENTUCKY AVENUE FROM THE WEST SIDE OF 19TH STREET TO THE EAST SIDE OF NAHM AVENUE AS A RESIDENTIAL DISTRICT, AND PRESCRIBING THE PENALTY TO BE IMPOSED FOR VIOLATION OF THE RESTRICTIONS SET FORTH IN A RESOLUTION ADOPTED BY THE CITY PLANNING AND ZONING COh!MISS_ON ON JULY 7TH, 1941", AND ALENDING SECTION 2 OF SAID ORDINANCE, INHICH ;':AS ADOPTED BY THE BOARD OF COLmISSIONERS ON JULY 8, 1941 WHEREAS, the City Planning and Zoning Commission has recommended the amendment of Section 2 of the aforesaid ordinance as shown by its final report embodied in a resolution adopted by it on May 16th, 1947; NOW THEREFORE, BE IT ORDAINED BY.THE WARD OF C012:ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the aforesaid final report of the City Planning and Zoning Commission be approved, and that Section 2 of an ordinance entitled: "ADI ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING COL2.'.ISSION PROVIDING FOR THE ZONING OF CERTAIN PROPERTY ON: BOTH SIDES OF KENTUCKY AVENUE FROM THE :'LEST SIDE OF 19TH STREET TO THE EAST SIDE OF NAHLS AVENUE AS A RESIDENTIAL DISTRICT, AND PRESCRIBING THE PENALTY TO BE IMPOSED FOR VIOLATION OF THE RESTRICTIONS SET FORTH IN A RESOLUTION ADOPTED BY THE CITY PLANNING AND ZONING C014.SISSION ON JULY 7TH, 194111, which was adopted by the Board of Commissioners on July 8, 1941, be and the same is hereby amended so that said section as amended shall read as follows: "SECTION 2. In order to further promote the general welfare of people in said district or zone and to enhance the desirability of same, all property within said area is subject to the following restrictions: 1. There shall not be erected upon any of the property within said area any dwelling house or apartment costing less than 87500.00 and such dwelling or dwellings shall be built of good quality commercial material. No trailer basement, tent, shack, garage, barn or other outbuilding erected in the tract shall at any time be used as a residence temporarily or permanently, nor shall any residence of a temporary character be permitted. 2. No residence building or apartment house shall be erected nearer than 25 feet from the front lot line, provided, however, that steps, windows, porticos and other projections appurtenant to such building may be within the 25 foot limit. All residences shall front upon Kentucky Avenue." SECTION 2. All ordinances and parts of ordinances in conflict herewith are to the extent of such conflict, hereby repealed. 4-/5s-6 d -r 19 64 LA SECTION 3- If any section or provision of this ordinance shall be found to be inoperative or ineffective for any cause, the invalidity of such section or provision shall not affect any other section or provision of this ordinance, it being the purpose of this ordinance to make each and every sectioh and provision hereof separable from all other sections and provisions.
