PLANNING AND ZONING COMMISSION TO AMEND SECTION 2 OF AN ORDINANCE
ENTITLED: "AN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY
PLANNING AND ZONING COMMISSION PROVIDING FOR THE ZONING OF
CERTAIN PROPERTY ON NORTH THIRTEENTH STREET FOR BUSINESS PURPOSES,
AND PRESCRIBING THE PENALTY TO BE IMPOSED FOR VIOLATION OF THE
RESTRICTIONS SET FORTH IN A RESOLUTION ADOPTED BY THE CITY PLANNING
AND ZONING COI:7,11ISSION ON JANUARY 29th2 1946", AND AMENDING SECTION
2 OF SAID ORDINANCE WHICH "."IAS ADOPTED BY THE BOARD OF COMMISSIONERS
ON JANUARY 29th, 1946.
WHEREAS, the City Planning and Zoning Commission has
(recommended the amendment of Section 2 of the aforesaid ordinance
as shown by its final report embodied in a resolution adopted by it
on June 22, 1949;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the aforesaid final report of the City
Planning and Zoning Commission be approved, and that Section 2 of a
ordinance bearing the title quoted above, which was adopted by the
Board of Commissioners on January 29th, 1946, be and the same is
hereby amended so that said section as amended shall read as follow
"Section 2. In order to further promote the general welfare
of the people in said district or zone and to enhance the desirabil
of same, all property within said area is subject to the following
restrictions:
(1) That no business building be permitted to be
constructed on any of said property that will
cost less than .'40,000.00.
(2) That no building permit be issued by the Building
inspector within the boundaries of the district
described above until the plans of said building
be submitted to and approved by the City Planning
and 4-oning Board."
SECTION 2. All ordinances and parts of ordinances in cont lici
herewith are, to the extent of such conflict, hereby repealed.
SECTION 3. If any section or provision of this ordinance
shall be found to be inoperative or ineffective for any cause, the
invalidity of such section or provision shall not affect any other
section or provision of this ordinance, it being the purpose of thi
ordinance to make each and every section and provision hereilf
separable from all other sections and provisions.
SECTION 4. This ordinance shall be in full force and effect
