AN ORDINANCE PROVIDING FOR THE AMENDMENT OF THE
FOURTH SUPPLEMENTAL CONSTRCT ENTERED INTO BETNEEN THE CITY OF
PADUCAH AND MARY DERONDA RIEKE, DOINBUSINESS UNDER THE FIRM
NAME OF THE PADUCAH BUS COMPANY ON JANUARY 26, 1949, THE SAME
FIXING THE RATES OR FARES FOR PASSAGE UPON MOTOR BUSES OPERATED BY
THE SAID MRY DERONDA RIEKE UNDER THE PROVISIONS OF AN ORDINANCE
ENTITLED: "AN ORDINANCE DIRECTING THE CITY MANAGER OF THE CITY OF
PADUCAH, KENTUCKY, TO SELL A FRANCHISE AUTHORIZING THE PURCHASER

TO MAINTAIN AND OPERATE MOTOR PASSEI4GER BUSES OVER AND UPON THE
STREETS, AVENUES AND PUBLIC WAYS IN THE CITY OF PADUCAH AND FIXING
T'IE TER?,IS AND CONDITIONS OF THE EXERCISE OF SAID GRANT", WHICH
ORDINANCE KNOWN AS "MOTOR BUS FRANCAISE NO. 2" WAS ADOPTED ON
FEBRUARY 1, 1944; SAID A:,IE_dDED CONTRACT TO BE REFERRED TO AS THE
FIFTIi SUPPLEMENTAL CONTRACT; PRESCRIBING THE TERMS AND CONDITIONS
TO BE CONTAINED IN SAID A..MENDED CONTRACT; AND AUTHORIZING THE
MAYOR PRO TEM TO EXECUTE. SAID AMENDED CONTRACT FOR AND ON BEHALF
OF THE CITY OF PADUCAH;
WHEREAS, on January 26, 1949, the City of Paducah,
Kentucky and Mary Deronda Rieke, doing business under the firm
name of Paducah Bus Company, entered into a contract providing for
the revision of the rates or fares to be charged for bus trans-
portation over the streets of the City of Paducah under the
provisions of a franchise held by the said Mary Deronda Rieke,
which franchise was created under an ordinance entitled:
"AN ORDINANCE DIRECTING THE CITY I:IANAGER OF THE CITY OF PADUCAH,
IENTUCKY, TO SELL A FRANCHISE AUTHORIZING THE PURCHASER TO
MAINTAIN AND OPERATE ISOTOR PASSENGER BUSES OVER AND UPON THE
STREETS, AVENUES AND PUBLIC WAYS IN THE CITY OF PADUCAH AND FIXING
TIM TERMS AND CONDITIONS OF TITS EXERCISE OF SAID GRANT", which
was adopted by the Board of Commissioners on February 1, 1944; and
WHEREAS; the parties desire to amend the aforesaid
contract of January 26, 1949, the same being referred to as the
Fourth Supplemental Contract;
NOW THEREFORE, BE IT ORDAINED BY 71iE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1.
That Paragraphs numbered 2 and 4 of the Fourth
Supplemental Contract entered into between the City of .Paducah
and Mary Deronda Rieke, doing business under the firm name of
the Paducah Bus Company on January 26, 1949, which paragraphs of
said contract are in words and figures as follows, to -wit:
11(2) That until the cancellation of this contract in
the manner hereinafter provided, any change of routes, in
schedules, or in the number of buses to be operated, as now

established and operating, shall be reported to and approved
by the city before becoming effective."
"(4) Except as modified by this Fourth Supplemental
Contract, all of the terms, agreements, conditions and coven-
ants contained in the aforesaid franchise ordinance shall
remain and continue in full force and effect, and the same
shall be in effect until the cancellation of this contract
in the manner set out above."
Be and the same are hereby amended so that said paragraphs as
amended shall read as follows:
"(2) That until the cancellation of this contract in the
manner hereinafter provided, the company shall maintain as a minimi
the operation of buses over the following routes now established ar
in effect and under the following schedules:
(a) Arcadia Route extending from let and Broadway to
the intersection of the Lone Oak Road and Blandville Road and
return to 1st and Br m dway, with operating schedule making bus
service available at intervals of time not exceeding 40 minutes
from each regular stop on said route.
(b) Avondale Route extending from lot and Broadway to the
intersection of 37th and Central Avenue and return to lst and Broad
with operating schedule making bus service available at intervals o
time not exceeding 40 minutes from each regular stop on said route.
(c) Crosstown Route extending from 4th and Broadway to
Noble Fark and return to 4th and Broadway; thence to the corner of
Powell Street and Locust Drive and return to 4th and Broadway, with
operating schedule making bus service available at intervals of
time not exceeding 30 minutes from each regular stop on said route.
(d) Guthrie Avenue Route extending from 1st and Broadway
to Schneidman Road and Markham Street intersection and return to
let and Broadway, with operating schedule making bus service avail-
able at intervals of time not exceeding 20 minutes from each regular
stop on said route.
(e) Rowlandtown Route extending from 4th and Broadway
to the intersection of the Cairo Road with Atkins Avenue and return
to 4th and Broadway, with operating schedule making bus service
available at intervals of time not exceeding 15 minutes from each
regular stop on said route.
(f) Tyler Route extending from 4th and Broadway to the
Farley School in Woodlawn or the intersection of the Oaks Road with
the Old Benton Road and return to 4th and Broadway, with operating
schedule making bus service available at intervals of time not
exceeding 20 minutes from each regular stop on said route.

(g) Union Station Route extending from 4th and Broadway
to Cully Street and Broom Avenue and return to 4th and Broadway,
with operating schedule making bus service available at intervals
time not exceeding 30 minutes from each regular stop on said route
It is understood and agreed that for a period of one (1)
year from this date and until a notice as hereinafter provided sha
be given after the expiration of one (1) year, the company shall h
the right, in its discretion, to operate extra buses and to provid
such bus transportation service as it may believe necessary in
addition to the aforesaid minimum operating requirements to be
complied with at all tires.
The city may, after the expiration of one (1) year from the
date of this contract, give to the company fifteen (15) days
written notice of its desire to revise the routes and schedules
upon which buses shall be operated to provide bus transportation
service as it may believe necessary in addition to the aforesaid
minimum operating requirements. In the event this privilege is
exercised, a public hearing shall be held and the company agrees
make effective at the end of said fifteen (15) day period those
routes and schedules which shall be approved by the board of
commissioners, provided the company shall not be required at that
or any other time during the period of this contract to establish
routes or schedules providing a more efficient motor transportat
system than the system which is being operated as e+f the date of
this contract.
"(4) Except as modified by this Fifth Supplemental Contract,
all of the terms, agreements, conditions and covenants contained i
the aforesaid Fourth Supplemental Contract and the aforesaid
franchise ordinance shall remain and continue in full force and
effect, and the same shall be in effect until the cancellation of
this contract in the manner set out above.
SEC TION 2.
That Stuart Johnston, the Mayor Pro Tem, be and he is
hereby authorized and empowered, for and on behalf of the City
of Paducah, to enter into a contract containing the aforesaid
amendments, said contract to be referred to as the Fifth Supple-
mental Contract.
SECTION 3.
All ordinances and parts of ordinances in conflict
herewith are, to the extent of such conflict, hereby repealed.

SEC TION 4.
This ordinance shall be in full force and effect from and
after its adoption.
