AN ORDINANCE AMENDING SECTIONS 1 AND 8 OF AN ORDINANCE
ENTITLED: "AN ORDINANCE PLACING OFFICES AND POSITIONS OF TRUST OR
EMPLOYMENT IN THE SERVICE OF THE CITY OF PADUCAH, KENTUCKY, UITDER
CIVIL SERVICE RULES AND REGULATIONS PURSUANT TO THE PROVISIONS OF
KRS 90.300 TO 90.900; PROVIDING FOR THE APPOINTMENT OF A BOARD OF
CIVIL SERVICE COMMISSIONERS, FIXING AND PRESCRIBIPIG THE QUALIFICA-
TIONS, TERMS OF OFFICE, POWERS AND DUTIES OF SAID COM1,1IS3IONERS;
PRESCRIBING THE RULES BY 'WHICH THE BOARD OF CIVIL SERVICE CO?81-
ISSIONERS SHALL BE GOVERNED IN THE GIVING OF EXAMINATIONS TO APPLI-
CANTS FOR EMPLOYMENT, FIXING THE NUMBER, CLASSIFICATION AND SALARIE
OF ALL EMPLOYEES IN EACH DEPARTMENT WHO SHALL BE AFFECTED BY THE
CIVIL SERVICE RULES AND REGULATIONS PROVIDED HEREIN; AND PRESCRIBIN(
THE RULES AND REGULATIONS GOVERNING 1HE CONDUCT OF ALL EMPLOYEES
AFFECTED THEREBY AND THE CAUSES FOR 'WHICH ANY EMPLOYEE MAY BE
REPRII.SANDED, SUSPENDED, DISMISSED OR REMOVED FROM EMPLOYMENT BY THE
CITY; PROVIDING FOR AND ESTABLISHING A RETIREMENT SYSTEM AND THE
CREATION AND I:7AI:;TENANCE OF A PENSION FUND FOR APPOINTIVE EMPLOYEES
OF THE CITY OF PADUCAH, IMNTUCKY, AND AUTHORIZING TIM LEVY OF A TAX
AND THE ASSESSMENT OF EMPLOYEES FOR THE CREATION AND MAINTENANCE C'
SAID FUND; PROVIDING FOR THE APPOII17MENT OF A BOARD OF TRUSTEES TO
ADMINISTER SAID FUND; FIXING AND PRESCRIEIIIG THE QUALIFICATIONS,
TER143 OF OFFICE, POWERS AND DUTIES OF SAID BOARD OF TRUSTEES; PRE-
SCRIBING THE RULES AND REGOLATIONS BY WHICH SAID BOARD OF TRUSTEES
ALL APPOINTIVE EMPLOYEES SHALL BE GOVERNED WITH REFERENCE TO THE
GRANTING AND ALLOWANCE OF PENSIONS AND OTHER BENEFITS AND PROVIDING
A SEPARABILITY CLAUSE", WHICH WAS ADOPTED BY THE BOARD OF COT,1MISSI
ON DECE14BER 2, 1947, AND AMENDED ON FEBRUARY 24, 1948, APRIL 20, 19
FEBRUARY 23, 1949 AND MARCH 22, 1949.
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That the position of Dump'Watchman is hereby
excepted from civil service status and for this purpose Sections 1
and 8 of the ordinance bearing the title quoted in the title of thi

ordinance be, and the same are hereby repealed, amended and reordained
so that said sections as amended and reordained shall read as follovls:
"SECTION 1. Definitions. The following words and phrases as
used in this ordinance, unless a different meaning is plainly shown
by the context, shall have the following meaning:
(a) "Employee" means any person employed in the conduct of
municipal affairs, including the head of a department and each admin-
istrative employee appointed by the City Manager, with the exception
of the Corporation Counsel, the Assistant Corporatioh Counsel, the City
Alcoholic Beverage Administrator, the Delinquent Tax Attorney, the City

Physician (white), and the City Physician (colored), and the Dump
Watchman, but the term shall not include the Mayor, a member of t
Board of Commissioners, the City manager, a member of the Police o
Fire Department, a member of the Board of Trustees of the Policeme
and Firemen's Pension Fund, with the exception of the City Treasur
who serves as ex -officio member, the City Planning and Zoning Board,
the Board of Adjustment, City Planning and Zoning, the City of Padu ah
Municipal,`ousing Commission, the City of Paducah Municipal Hospita,
Commission, the Commissioners of the Paducah Water S7orks, the Board
of Trustees of the Public Library, or any employee of said boards
or commissions, or the trustees, members or corresponding officer I
of any similar boards or commissions of a city of the second class
now or hereafter created, or any employee of such boards or comm-
issions, or to any person employed on temporary and special projects,
or to any person whose regular employment with the city is seasonal
and is less than nine months in any one year.
(b) "Appointing authority" means the officer, commission
board or body having the power of appointment or removal in any
office, department, commission, board or institution.
(c) "Civil service" means the offices and positions of trust
not specifically excluded by KRS 90.310 or 90.410 or by ordinance
of the city.
(d) "Commission" means the board of Civil Service Commissioners
as established under KRS 90.310.
(e) "The Board of Trustees" shall mean the Board of Trustees
of The Appointive Employees' Pension Fund created under the fpro-
visions of this ordinance.
(f) "Pension fund" means the moneys derived from the employees
and the levy of a special tax, either or both, or by any other sum
derived from any other source, to be used for the retirement of
employees after the prescribed years of service and for the benefit
of disabled employees, and widows and dependent children in the case
of death of an employee within the scope of his employment accord-
ing to the terms of KRS 90.310 to 90.410 and the ordinances of the
city.
(g) "Widow" as used in this ordinance shall mean any woman
legally married to an employee where there has been no decree of
divorce dissolving the marriage and where the wife has not, at the
time of the death of the employee, voluntarily abandoned him.

in the department of Public Works and in the Engineering, Street,

of each position, provided the amount of such salary is not changed
under any apportionment ordinance hereafter adopted, shall be as follows:

SECTION 2. All ordinances or parts of ordinances in conflic
herewith are, to the extent of such conflict, hereby repealed.
SECTION 3. This ordinance shall be in full force and effect
