HomeMy WebLinkAboutOrdinances Book 11, Page 5, No Ordinance NumberAN ORDINANCE PRESCRIBING THE RULES AND REGULATIONS FOR THE POLICE DEPARTMENT OF THE CITY OF PADUCAH, KENTUCKY, PRESCRIBING THE QUALIFICATIONS, POWERS AND DUTIES AND FIXING THE COMPENSATION 'OF THE MEMBERS OF THE POLICE DEPARTMENT, PROVIDING A SEPARABILITY CLAUSE, AND REPEALING ALL ORDINANCES IN CONFLICT THEREVITH BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION ONE Definitions The words "Regular Policemen" whenever used in this ordinanc shall mean all members of the regularly constituted police depart- ment appointed and commissioned by the City Manager and they shall include the chief of police, assistant chief of police, captains, lieutenants, sergeants and privates permanently employed as police officers. The words "Special Policemen" shall mean all persons who may be temporarily employed by the City Manager pursuant to an ordinan authorizing the employment of such persons to do special police duty within the city, or to assist the regular police officers in the event of a riot. strike, insurrection, unlawful assemblage or any other emergency which threatens the peace and good order of the community. SEC TIOI1 Ti110 Duties of Regular Policemen The City Lianager shall appoint the assistant chiefs, captains lieutenants, sergeants and patrolmen provided for by the annual apportionment ordinance and the budget or by any emergency appro- priation ordinance. It shall be the duty of each member of the police force to acquire and have a general knowledge of the crimina laws of the state and of the ordinances and regulations of the city ?mhich he may be called upon to enforce, and to use his best exertio to prevent the commission, within the police jurisdiction of the city, of offenses against the laws of the state and the ordinances and regulations of the city, to observe and enforce all such laws, ordinances and regulations, to detect and arrest offenders, to observe the good order of the city, and to secure the inhabitants thereof and persons within the city from violence and property from injury. Each policeman shall, under the supervision of the City Manager, be authorized and empowered, and it shall be his duty, to c and perform all acts and things required by general law and or ordinances of the city, to be performed by policemen, and they shale perform such other duties as may be required of them by ordinances or by the City Manager. dM6/YDaD 2-1 /Y17 6 SECTION THREE Duties of Special Policemen Special policemen shall have the power to make arrests and to perform such duties as may be required of them by ordinance. No person shall be employed as a special police officer for a longer period than one month, the amount of his compensation to be fixed by ordinance and not to exceed the rate of pay of a Grade "A" patio: man. Special policemen shall not acquire any rank, position, right of seniority or other benefit under the rules of civil service by reason of the services rendered by them. SECTION FOUR Salaries and Rank of Regular Policemen Regular policemen shall receive such salaries as may be provide 1 for in the annual appropriation ordinance, or in any emergency appr priation ordinance. The rank of the members of the Police Department and the salaries to be paid to them, provided said salaries are not changed by any annual apportionment ordinance hereinafter adopted, shall be as follows: Position Number Monthly Salary (1) Chief of Police 1 4$250.00 (2) Assistant Chief of Police 1 187.50 (3) Captains 6 182.50 (4) Lieutenants 4 172.50 (5) Sergeants 6 162.50 (6) Patrolmen (Grade A) 20 157.50 (7) Patrolmen (Grade B) 4 149.60 SECTION FIVE Duties of Chief of Police The City 1-anager shall appoint a chief of police, whose duty it shall be to command and supervise the police force of the city under the direction of the City Manager, and to see that their duties as deined by law and ordinances of the city are properly performed; and the chief of police shall, under the supervision of the City Manager, be authorized and empowered, and it shall be his duty, to do and perform all acts and things require by law and or ordinances of the city to be performed by the chief of police; and he shall perform such other duties as may be require of him by ordinance or by the City Manager. SECTION SIX Qualifications for Employment Qualifications of applicants for membership in the police department shall be as follows: The applicant must be a man of sobriety and integrity, at least twenty-one (21) years of age and not over forty (40) years of age, and an orderly, law-abiding citizen. He must have been graduated from an accredited high school. He must also be a qualified voter of the city and able to pass an "A One" physical examination by a physician appointed by the City Manager, and furnish references from at least five (5) reputable citizens. SECTION SEVEN Classification of Privates All patrolmen now in the service as members of the police department, and all persons assigned to grades and positions herein defined at the present time, shall hold their respective positions, and no employee now or hereafter employed shall be promoted from a Grade "B" to a Grade "A" patrolman until he has efficiently and faithfully served continuously to the satis- faction of the City Mianager for a period of one (1) year. Such patrolman may then upon application to the City Manager be trans- ferred from Grade "B" to Grade "A", and if the City Manager consider i his service has been efficient, satisfactory and faithful, and said service has been continuous for one (1) year, he .5hall thereupon be so transferred. SECTION EIGHT Manner of Appointment All original appointments to membership in the police department shall be made by the City P.lanager and in the event of a vacancy, the City Manager may appoint a suitable person to fill such vacancy. SECTION NIKE raa''V LNDED Rules Governing Conduct f( I In addition to the causes for dismissal, suspension .fir/5E, / I ,ice and demotion provided by law, any member of the police department may be reprimanded, dismissed, suspended or reduced in grade or pay for any of the following causes: 7 (1) Drinking beer, wine, whiskey or any other alcoholic or intoxicating liquor while on duty or while wearing any part of his (2) Being intoxicated either on or off duty. (3) Insubordination or disrespect to superior officers, or msal or failure to obey or execute any command or order given by a uperiod officer. (4) Loitering while on duty or while wearing any part of hi niform. .(5) Conviction in any court of a felony. (6) Attempting in any way to influence any person's vote in ny election, or interfering with or obstructing the holding of any lection or registration of voters. 8 �I (7) Suffering his pay or salary to be garnished three (3) time i for a just debt for necessaries for himself or family contracted during his employment for the city. (8) Cowardice, inefficiency or neglect in the performance of duty or disobedience of lawful orders of a superior officer. (9) Such mental, physical or educational incapacity or disability as renders him incapable of properly performing his duty. (10) Abandonment of, without just cause, or failure to support his family (11) Any immoral habits, lascivious or improper conduct not herein enumerated which would render him an unfit or improper perso for employment in the Police Department. (12) The acceptance of any gift or contribution of any kind fr m any person or persons which may be calculated to place such member of said police department under obligation to the contributor or an one else. (13) The communication of information concerning the plans, activities or secrets of the Police Department, or the divulging, giving out or disclosing of the name of any informer concerning law violators to any person not a member of said department. Provided, however, that this provision would not apply should its application prevent cooperation with other departments of the city government through their duly constituted heads or with the law enforcement officers of any political sub -division of the Commonwealth or of the United States. (14) Entering any disorderly house or place except in the discharge of duty. (15) Using indecent, profane or obscene language while on duty or while wearing any part of his uniform. (16) Using unnecessary force or brutality in making arrests or handling prisoners. (17) Being tardy or absent from any roll call or loitering unnecessarily at police headquarters. (18) Impoliteness or rudeness in dealing with the public or in performance of duty. (19) Slovenliness or untidiness in his person or uniform or failure to weat the prescribed uniform while on duty. (20) Leaving his regular beat unless in the performance of duty, or upon order of's superior officer. (21) Being absent from duty without proper permission. Police officers shall have permits from the chief of police or their superior officer temporarily on duty for any absence from their regular post or assignment, and no officer shall be off duty without 9 Permission properly granted to him, and any officer who shall absent himself from dmty without such permission shall forfeit his pay during the period of such absence and be dismissed from service. (22) Engaging in disputes or quarrels with another officer or officers while either or any of them are on duty, or using any indecent, obscene or profane names or language in addressing any officer or other person. SEC TI oil TETT Any member of the police department who shall be found guilty as now provided by law, upon the hearing of charges for violating the rules and regulations prescribed in the preceding section, shall be reprimanded, dismissed, suspended or reduced in grade or pay in the discretion of the Board of Commissioners. SECTION ELEVEN When a member of the Police Department is demoted by the Board of Commissioners from one grade or classification to a lower grade or classification, he shall have the same status as one appointed or promoted to such lower grade. A suspended member shall receive no pay during the time of his suspension unless he be acquitted of the charge or charges against him, and if so acquitted he may be allowed pay"for the time so suspended by order of the Hoard of Commissioners. SECTICId T7ELVE WAAEINI ID?:Eli 1:'earxng Apparel �k� 0 -- All members of the police department excepting those assignee to duty as Chief, Assistant Chief and detectives shall wear the standard uniform, which shall be the same as worn by members of the department and which shall consist of a standard blue shirt, black tie and Sam Browne belt. The above shall constitute the standard winter uniform. The standard summer uniform shall consist of the above with the exception of the uniform coat, and with the further exception of a standard cap, part of which may be made of white material and such other modifications in weight and quality as may be deemed to the best interest of the department and.the confort and convenience of the members thereof, and to be determin by the chief of police with the approval of the City Manager. SECTION THIRTEEN Insignia The insignia to be worn designating the respective ranks is as follows; 10 i . f. Chief of Police Four (4) gold stripes on the cuffs Assyt Chief of Folice Three (3) gold stripes on the cuffs Captains Two (2) gold stripes .on the cug£s Lieutenants One (1) gold stripe on the cuffs Sergeatns One (1) red stripe on the cuffs The collars of all uhiform coats shall have the letters P.P.D. thereon on a lapel insignia. Uniform buttons shall be of goldish tint with the letter P. pressed in said buttons. SECTION FOURTEEN Use of Motor Driven Equipment No members shall use the automotive equipment of the Police Department except in the performance of duty; and no member shall drive said equipment at an excessive rate of speed, except in pursuit of law violators. Every menber shall strictly observe all traffic laws, ordinances and regulations of the City except in case ;of real emergency when the public interest or safety requires it. Each member using said automotive equipment shall use every pre- caution to preserve the same in good order and good appearance, and if any injury or damage results to said equipment so in charge of a member by his negligence or improper use thereof, he shall be held responsible to the City for such damage or injury, SECTION FIFTEEN Disability Any member of the police department may be required to submit to a physical examination at any time if requested by the City Tianager to do so and the examination shall be made for the purpose of determining whether the member is physically able to discharge the duties of his office. The request shall be made in writing. One physician shall be appointed by the City i-lanager and another by the member to be examined and if they disagree, a third physician shall be appointed by the two PAysicians first appointed and the opinion of two of said three physicians shall be final. Appointments of physicians shall be made and a report filed with th City Manager within thirty (30) days after the examination has been requested. The expense of such physicial examinations shall be pail by the City. In the event it is found by the physicians appointed to make sudh examination that said member has become temporarily totally disable, physically or mentally, while in the performance of duty and by rea on of service in the department, the Board of Commissioners shall have the right to grant said member a leave of absence for not longer than six (6) months, and said member shall be entitled to the Services of the City Physician during that period without charge. 11 Additional leaves of absnece may thereafter be granted to such disabled employee for further periods of six months unless or un- til it is found by examining physicians that he has become totall and permanently disabled. If it is disclosed by the examination of any member that he has become disabled, physically or mentally, out that such dis- ability was not caused while in the performance of duty or by reason of service in the department, it shall be the duty of the City Manager to file with the L-oard of Commissioners written charges for the removal of said member on the grounds set forth in sub -section Nine of Section Ten of this ordinance. SECTION SIXTEEN Any and all awards, fees and donations of any kind collected Dy members of the Police Department shall be delivered to the chief i of aolice :rho shall forthwith turn same over to the Treasurer of 7O% the City of Paducah to be deposited to the credit of the Police an Firemen's Pension Fund. 'L_tq SECTION SEVENTEEN All ordinances and parts of ordinances in conflict herewith, are to the extent of such conflict hereby repealed, and the provis ons of this ordinance are hereby delcared to be severable, and if any provision hereof shall be found or declared to be invalid, such decision or invalidity shall not affect the remaining provisions of this ordinance, it bein, the intention of the Board of Commissioners to enact each and every provision contained herein separately and irrespective of any other provision. SECTION EIGHTEEN This ordinance shall be in full force and effect from and after its adoption.
