AN ORDINANCE REQUIRING gIE EXECUTION OF A BOND;
BY ANY PERSON, FIRT;I OR CORPORATION PROCURING A LICENSE TO SELL OR
DISPENSE ALCOIiOLIC BEVERAGES VIITIIIN THE CITY OF PADUCAH AND PRESCRIB-i
ING THE FORTS OF BOND REQUIRED FOR SUCII PURPOSE MID FIXING THE PENALTY,
FOR VIOLATION OF SAID ORDINANCE:
WHEREAS, under and pursuant to the provisions
of the Alcoholic Beverage Control Law, Acts of the 1938 General As-
sembly of Kentucky, every applicant for a license to sell and dis-
pense intoxicating liquors within the Commonwealth of Kentucky is
required to submit with his application therefor a bond to the Com-
monwealth of Kentucky in such penal sum as may be prescribed by the
rules and regulations of the State Alcoholic Beverage Board, con-
ditioned that such applicant, if granted t.,e license sought, will
not suffer or permit any violation of the provisions of said Act
and that all fines and penalties which shall accrue during the time
that the license shall be in effect will be paid, together with all
costs taxed or allowed in any proceeding brought or instituted for
a violation of any of the provisions of said Act; and,

Act that the functions, powers and duties of the City alcoholic
Beverage Administrator shall be the same, with respect to city
licenses and regulations, as the functions, powers and duties of the
State Alcoholic Beverage Control Board with respect to state licenses'.
and regulations, except that no rule or regulation adopted by any
City Administrator may be less stringent than the provisions set up
in said Act or than those set up in the rules and regulations of the
State Board;
NOW, THEREFORE, be it ordained by the Board of
Commissioners of the City of Paducah:
SECTION 10
No person shall be permitted to engage in the
business of selling or dispensing alcoholic beverages in the City of
Paducah, nor shall he receive or have issued to him any license so tol
do until he has executed with corporate surety approved by the City
Alcoholic Beverage A?ministrator as to solvency and responsibility
and authorized to transact business within this Commonwealth, a bond'
in such penal sum as may be prescribed by the rules and regulations
of the State Alcoholic Beverage Board, and which bond shall be in
substance in the following form, to-wit:-

license in accordance with the Alcoholic Beverage Control Law, Acts of the
1938 General Assembly of Kentucky, now we,--------------------------------,

Thousand Dollars ($1,000.00) that the said Principal will not suffer or
permit any violation of the provisions of said law as it may be amended or
of regulations issued pursuant thereto, or of any ordinance of the City of
Paducah, and in the event of any such violation that all fines and penal-
ties which shall accrue during the time that the license will be in effect)
shall be paid, together with all costs taxed or allowed in any proceeding
brought or instituted for a violation of any of the provisions of said

The bond shall not be binding on either Principal or
Surety unless the license applied for and for which this bond is required
is issued to the Principal upon proper authority of the City Alcoholic
Beverage Administrator and shall be subject to cancelation upon sixty
(60) days' notice by the Principal, Surety or proper authority of the
Commonwealth of Kentucky. This bond shall expire on June 30 following
date of execution.

SECTION II
Any person, firm or corporation violating any of the .

provisions of this ordinance shall upon conviction be fined not less than
Fifty ($50.00) Dollars nor more than One Hundred ($100.00) Dollars,or Bon-
in the city jail not less than ten (10) days nor more than thirty (30)
days, or both so fined and imprisoned.

SECTION III
IsAll ordinances and parts of ordinances in conflict
herewith are hereby repealed.
SECTION IV
This ordinance shall take effect from and after the
date of its adoption.
