All ORDINANCE AUTHORIZING THE CONVEYANCE TO THE COMMONBJEALMil -
OF KENTUCKY OF A DEED Of CONVEYANCE TO CERTAIN STREETS IN THE
CITY OF PADUCAH, KENTUCKY, WHICII ARE TO BE MAINTAINED BY THE
DEPAR 7,1ENT OF HIGIRVAYS UNDER AND PURSUANT TO THE PROVISIONS OF
CHAPTER 30 OF THE ACTS OF THE GENERAL ASSEI.SBLY OF 1942, AND PRE-
SCRIBING TIE TERAS AND CONDITIOIiS UNDER INIIICH SAID STREETS SHALL
BE rOITVE'CED
THAT WHEREAS, under and pursuant to the provisions of
Section 177,010, et seq., of the Kentucky Revised Statutes, being
Chanter 30 of the Acts of 1942, the City of Paducah, Kentucky,
and J. Lyter Donaldson, Commissioner of 11ighway4 of the Common-
-wealth d Kentucky, have heretofore entered into a Contract dated
January 21st, 1943, and by the terms of which the Department
of Highways designated certain streets in the City of Paducah as
necessary connecting links of Federal and State hi�-hways passing
V,roudh said city, the streets so designated bein_- described as
follows:
Fountain Avenue from Kentucky to Park
Park Avenue from Fountain to ',;est City Limits
Bridge Street from East City Limits to Broad Street
Broad Street from bridge Street to 6th Street
6th Street from Broad to Jefferson Street
Jefferson Street from Sth to 8th Street
8th Street from Jefferson 3t. to the Paducah-Brookoort
Kentucky Street from Sth Street to 28th Street
28th Street from Kentucky Street to Broadway
Broadway from 28th St. to Lovelaceville Road
Lovelaceville Road from Broadway to South city limits
North 32nd Street from Broadaay to the intersection
of U.S. 60 near city limits.
AND ':Ti AREAS, it was provided In said contract that the
Denartnent of Hi`hways, as soon as practicable after its execution, I)
will begin the necessary work to maintain the above mentioned streets
and bear all of the cost of the maintenance thereof so long as sai.:1
streets remain designated as a part of the state hi hriay system of
the State or Federal Hi^hways through said city; -and,

WHEREAS, it was provided under Section 177,045 of the
Kentucky Revised Statutes that when the Comminsioner of Highways 1
has desiCnated any street in the city as a part of the state
primary road system, no construction, reconstruction, mdintenance
or repair of the street shall be done by the Department of I
Hi^h::'ays until the City has conveyed to the Commonaealth of
�! Kentucky, without cost to the state, all rights -of -ways it ovine
!i upon which the street is located;

SECTIOII 1.
That the Irlayor and City Clerk be, and they are hereby
authorized to execute, for and on behalf of the City of Paducah,
Kentucky, a deed of conveyance under which the City of Paducah
shall convey to the Commonwealth of Kentucky the rights-of-way
to and easements in, over and through the above described streets
In consideration of the agreement of the department of Highways
to assume the liability for the construction, reconstruction and
maintenance of the aforesaid streets, the same to be conveyed for
the uses and purposes set forth in Chapter 30 of the Acts of the
General Assembly, Commonwealth of Kentucky, adopted at its 1942
regular session; provided, however, that in the event said streets
should be adandoned as a part of the „tato Primary road system by
order of the Department of Iiighways, the aforesaid rights-of-way
and easements shall automatically revert to the City of I-aducah.
SEC TION 2.
This ordinance shall be in full force and effect from and
after its adoption.
