TANDY SISITH, JR., FOR SERVICES _,E`i=,I;L-_ IN COIiIIEC.'ION WITH THE CONSTRUCTION OF SAID LULDINGS AND A' DIT'IG:IS ':'HE ;AS, the Board of Ed.1cation of Paducah, Kentucky, having submitted to the Board of Commissioners of the City of Paducah, a resolution recommending that the city accept as fully completed the TilEhman Iiigh School buildings which was constructed under Contract No.3, the same beinC designated and known among the records of the Federal Emer ency Administration of Public 'corks as (Project No. ICY -1219 -DS, and having resommended that the balance due i on the contract price be paid to the Contractor, Rock City Con- struction Company, and that payment be made to the irchitect, G. Tandy Smith, Jr., pursuant to the contract �Leretofore approved by the Board of Commissioners; and, 71HEREAS., it is provided under the contract entered into between the owner, City of Paducah and the contractor, Rock City Construction Company, that the balance of the contract price for thel construction of said buildings shall be paid upon the completion of isaid buildings, and the acceptance thereof by said City, and that the balance of said contract price amounts to X25,119.91; and, C'.K ;SAS, the City of Paducah has received statements that certain material men are claiming amounts due them by the said Rock I City Construction Company on account of materials furnished the Sherrill- Rus aell Lumber Company, and which accounts as claimed by said material men are as follows: Pittsburg Plate Glass Co X221.57 j Paducah cash Door Co 312.00 Carahan L:fL:.Co 745.24 Cole PSg. Co 741.22 Total 2,020.03 AND, ".TziR'_EAS, a suit having been instituted in the Y.c- cracken Circuit Court wherein certain of the aforesaid material men are claiming liens superior to those asserted by other claimants, hand the City of Paducah, having been notified concerning the liens lasserted by each of the aforesaid material men against said property,!, i 'To'.!, THEREFORE, BE IT RESOLVED BY THE BOARD OF COI:;.'.'I..SION-i i ERS OF 71 E C ITY OF PADUCAH, KENTUCKY: SI-CTIC17 1. That the buildings and additions constructed to the city i lschools of Paducah, Kentucky, under contract I:o.3, be and the same I Pale 88 are hereby approved and accepted as fully completed. SECTION 2. That the City of Paducah pay to the contractor, Rock City Construction Company, out of its account on deposit in the Peoples k,ational Bank of Paducah, Kentucky, the sum of t1'23,099.B2 upon being furnished by said contractor with affidavits or other satis- factory evidence that with the exception of the accounts listed above, all bills for labor performed and materials furnished in connection with the construction of said buildings, additons and improvements have been fully paid, and that no other person, firm or corporation can assert a lien against said property by reason of any labor performed or materials furnished in the performance of said contract, and the balance due on said contract price amounting; to w2020.03, shall be held by said cit; subject to the orders of the McCracken Circuit Court. SECTI07T 3.
