AN ORDINANCE ASSESSING THE ABUTTING PROPERTY ON BOTH SIDES OF

EAST PROPERTY LINE OF PALM STREET, EXCLUDING INTERSECTIONS AT
HARRISON STREET, CLAY STREET, PARK AVENUE, BERNHEIM AVENUE AND THAT!
PORTION ALREADY PAVED BETWEEN PARK AVENUE AND BERNHEIM AVENUE IN THE
CITY OF PADUCAiI, MCCRACKIN COUNTY, KENTUCKY, FOR THE PORTION OF THE'
COST OF CONSTRUCTION OF SAID STREET AND IMPROVEMENT THEREOF, BY TILE:
PLACING THEREIN AND THEREON OF A CONCRETE CURFACE, TOGETHER WITH ALL
NECESSARY,' CURBS, GUTTERS, DRIVEWAYS, MANHOLES, INTAKES, CATCH BASINS,
Ii SEWER AND DRAIN PIPES AND ALL NECESSARY ENGINEERING, EQUIPMENT, ADVER-
TISING AND LEGAL AND CLERICAL SERVICES IN CONNECTION THEREWITH UNDER
THE PROVISIONS OF AN ACT OF THE GENERAL ASSEMBLY OF TILE COMMOA71EALTH
OF KENTUCKY ADOPTED AT ITS REGULAR SESSION IN 1938 PROVIDING FOR THE

11IMPROVEMENT OF PUBLIC WAYS IN CITIES OF THE SECOND CLASS BY AID OF
TITHE WORK PROJECTS ADMINISTRATION OR OTHER AGENCIES OF THE FEDERAL OR
(STATE GOVERNMENT, AND AT THE EXCLUSIVE COST OF THE OWNERS OF REAL
ESTATE ABUTTING ON SUCH IMPROVEMENT ACCORDING TO THE NUMBER OF FRONT
OR ABUTTING FEET, AND PROVIDING THAT A TAX SHALL BE LEVIED UPON SAID
*TS OR PARCELS OF REAL ESTATE FOR THE PAYMENT OF THE COST ASSESSED
THEREON, WHICH COST SHALL BE THE DIFFERENCE BETWEEN TIIE TOTAL COST
OF COMPLETING SAID IMPROVEMENT AND THE TOTAL AMOUNT OF THE CONTRIBUTION
OF TIIE WORK PROJECTS ADMINISTRATION OR OTHER AGENCIES OF THE FEDERAL
OR STATE GOVERNMENT ENGAGED IN MAKING SAID IMPROVEMENT, AND N.HICH TAX

SHALL BE DUE AND PAYABLE AT THE OFFICE OF THE CITY TREASURER IN TIE'
CITY HALL IN PADITCAH, AND ONE-HALF OF THE WORI{ HAVING BEEN COMPLETED
AND THE ESTIMATED COST ASCERTAINED, AND IT BEING DETERMINED FROM SAID
ESTIMATES AFTER DEDUCTING THE AMOUNT TO BE CONTRIBUTED BY THE WORK
PROJECTS ADMINISTRATION OF THE UNITED STATES THAT TIIE AMOUNT REQUIRED

TO BE CONTRIBUTED BY THE ABUTTING PROPERTY OWNERS OF 12TH STREET
SHALL BE $2.05 PER ABUTTING FOOT; and, i
WHEREAS, the Board of commissioners has heretofore adopted an
ordinance providing for the construction and reconstruction of
said driveway under the terms of said Act aforesaid, and pursuant
to its provisions; and,
WHEREAS, work on said improvement has been half completed
and hereby declared by the Board of Commissioners to have been half+
completed on and before this date, and the estimated cost thereof is
dare due to be paid to the City Treasurer, and the .first half thereof
having been assessed at the time of commencement of said work, and the
(last half is due to be assessed when the work is held completed,
NOV1, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, IENTUCKY:

That all of the property on both sides of 12th Street from
the North property line of Madison Street to the East property line
of Palm Street, excluding intersections at Harrison Street, Clay
Street, Park Avenue, Bernheim Avenue and that portion already paved
between Park Avenue and Bernheim Ave in the City of Paducah, McCracken
County, Ky., as shown by estimates on file in the Engineers office
in the City Hall in the City of Paducah Kentucky, be and the same is
hereby assessed for the cost of construction of said paved street with
all necessary curbs gutters drivewyas, manholes, intakes, catch basins,
sewer and drain pipes and all necessary engineering, equipment,
advertising and legal and clerical services in connection therewith
the portion of said cost of improvement required to be paid by said
r,roperty owners shall be the following amount per front foor; to -wit:
Total cost against the property owners between P:iadison Street and
Palm Street on 12th Street is .1p2.05 per front foot for street paving;
that all of said estimates are on file in the office of the Engineering
Department in the City Hall, and are reCerred to and made a part
hereof.
SECTION 2.
That one-half of said assessments as against each lot as shown
by said assessment and estimate of said Engineer was due at the
commencement of said work and has heretofore been assessed, and the
Board of Commissioners having by this ordinance determined that said
work has been half completed and the last half of said assessment
is now due to be paid, said last half shall be paid within ten (10)
days after the adoption of this ordinance and unless so paid there shall
be added thereto a penalty of 6o and a lien is declared to exist upon
said lots and parcels of real estate for the proportionate cost of
said improvement so assessed as herein provided in addition to the
assessment for the first half of the cost thereof as hereinbefore
made; and the amount of said assessment shall bear interest upon any
part thereof that remains unpaid for ten (10) days after the same is
due to be paid as herein provided at the rate of 6% per annum in
addition to the penalty aforesaid, which lien shall be superior to all
other liens except the liens for State, County and City taxes.
SECTION 3.
The publication of this ordinance shall be notice to all
persons interested and due to pay said assessment, of the time and ,
place to pay the same. Said assessment will be paid within ten (10)
days from the publication of this ordinance.

SECTION 4.
This ordinance shall be in full force and effect from and
after its adoption.
