9TH STREET FROM THE SOUTH PROPERTY LINE OF KENTUCKY AVENUE TO THE
SOUTH PROPERTY LINE CF ADAMS STREET, EXCLUDING INTERSECTION AT CLARK
'STREET IN THE CITY OF PADUCAH, MCCRACKEN COUNTY, KENTUCKY, FOR THE
PORTION OF THE COST OF CONSTRUCTION OF SAID STREET AND IMPROVEMENT
THEREOF, BY THE PLACING THEREIN AND THEREON OF A CONCRETE SURFACE
TOGETHER WJITH ALL NECESSARY CURBS, GUTTERS, DRIVEWAYS, MANHOLES,
INTAKES, CATCH BASINS, SEWER AND DRAIN PIPES, AND ALL NECESSARY
ENGINEERING, EQUIPMENT, ADVERTISING AND LEGAL AND CLERICAL SERVICES
IN CONNEC U ON THEREWITH UNDER THE PROVISIONS OF AN ACT OF THE GENERAL
ASSEMBLY OF THE COMMON7EALTH OF KENTUCKY ADOPTED AT ITS REGULAR
SESSION IN 1938 PROVIDING FOR THE TMIR OVEMENT OF PUBLIC WAYS IN
CITIES OF THE SECOND CLASS BY AID OF THE WORK PROJECTS ADMINISTRATION
OR OTHER AGENCIES OF THE FEDERAL OR STATE GOVERNMENT, AND AT THE
EXCLUSIVE COST OF THE OWNERS OF REAL ESTATE ABUTTING ON SUCH

IMPROVEMENT ACCORDING TO THE NMABER OF FRONT OR ABUTTING FEET, AND
PROVIDING THAT A TAX SHALL BE LEVIED UPON SAID LOTS OR PARCELS
OF REAL ESTATE FOR THE PAYMENT OF THE COST ASSESSED THEREON, WHICH
COST SHALL BE THE DIFFERENCE BET."IEEN THE TOTAL COST OF C014PLETING
SAID IMPROVEMENT AND THE TOTAL AisiOUNT OF THE CONTRIBUTION OF THE
(WORK PROJECTS ADMINISTRATION OR OTHER AGENCIES OF THE FEDERAL OR
STATE GOVERNMIENT ENGAGED IN MAKING SAID IMPROVEMENT, AND YJHICH
TAX SHALL BE DUE AND PAYABLE AIT T&E OFFICE OF TfiE CITY TREASURER
IN THE CITY HALL IN PADUCAH, ONE-HALF THEREOF WHEN THE WORK OF

BY THE BOARD OF COT.MISSIONERS WITH THE ADVICE OF THE CITY ENGINEER;I
AND ALL THE ENGINEERING WORK HAVING BEEN COMPLETED AND THE ESTIMATED
COST ASCERTAINED, AND IT BEING DETERMINED FROM SAID ESTIMATES AFTER
DEDUCTING THE AMOUNT TO BE CONTRIBUTED BY THE WORK PROJECTS
ADMINISTRATION OF THE UNITED STATES THAT THE AMOUNT REQUIRED TO BE
CONTRIBUTED BY THE ABUTTING PROPERTY OWNERS ON 9Th STREET BETWEEN
KENTUCKY AVENUE AND WASHINGTON STREET IS $2.05 PER FRONT FOOT FOR
STREET PAVING; BETWEEN WASHINGTON STREET AND ADAMS STREET $1.90 PERI

FRONT FOOT FOR STREET PAVING; ALL CURBS SHALL BE $.30 PER LINEAR FOOT;
ALL GUTTERS SHALL BE $.20 PER LINEAR FOOT; DRIVEWAYS S:ALL BE y1?.12
PER SQUARE FOOT; AND THE CITY OF PADUCAH BEING NO'd READY TO COMMENCE
WORK ON SAID IMPROVEMENT AS OF THE DATE OF THE ADOPTION OF THIS
ORDINANCE
WHEREAS, the Board of Commissioners has heretofore adopted
an ordinance providing for the construction and reconstruction of
said driveway under the terms of said Act aforesaid, and pursuant
to its provisions; and,

WHEREAS, work is now ready to begin on said construction
and one-half of the estimates cost thereof is now due to be paid to
the City Treasurer,
NOW, THEREFORE, HE IT ORDAINED BY THE BOARD OF COJrMI3SION-
ERS OF THE CITY OF PADUCAH, KENTUCKY:
SEC TION 1.
That all of the property on both sides of 9th street from
,,the South property line of Kentucky Avenue to the South property
line of Adams Street, excluding intersection at Clark Street in the,

City of Paducah, McCracken County, Kentucky, as shown by estimates
,on file in the Engineer's Office in the City Hall in the City of
Paducah, be and the same is hereby assessed for the cost of construe -
tion of said paved street with all necessary curbs, gutters, drive—
ways, manholes, intakes, catch basins, sewer and drain pipes and
all necessary engineering, equipment, advertising and legal and
clerical services in connection therewith, the portion of said cost
of improvement required to be paid by said property owners shall be

ithe following amount per front foot, to -wit. Total cost against the
li
property owners between Kentucky Avenue and 1.9ashington Street is
$2.05 per front foot for street paving; between Washington Street and
,Adams Street $1.90 per front foot for street paving; all curbs shall
I;be $0.30 per linear foot; all gutters shall be $0.20 per linear foot
!'all driveways shall be $0.12 per square foot; and all of said
estimates are on file in the office of the Engineering Department
in the City Hall, and are referred to and made a part hereof.
SECTION 2.
That one0half of said assessment as against each lot as shown
I!by said assessment and estimate of said engineer is now due and unless
paid within ten (10) days after the adoption of this ordinance there
shall be added thereto a penalty of 6% and a lien is declared to
exist upon said lots and parcels of real estate for the portion of
cost of said improvement so assessed as herein provided, and the
amount of said assessment shall bear interest upon any part thereof.
that remains unpaid for ten (10) days after same is due to be paid
at the rate of 6o per annum in addition to the penalties aforesaid,
which lien shall be superior to all other liens except the lien for
State, County and City taxes.
SECTION 3.
The publication of this ordinance shall be notice to all
persons interested and due to pay said Assessment, of the time and

place to pay the same. Said Assessment will be paid one-half within I
ten (10) days from the publication of this ordinance, and the other
one-half will be paid when the Board of Commissioners shall declare by
ordinance or resolution, that said work and said Improvement has been
one-half completed.
SECTION 4.
This ordinance shall be in full force and effect from and
after its adoption.
