BE IT ORDAInTED BY THE BOARD OF COMIII3SIOHERS F THE CITY OF PADUCAH, KEITTUCKY: SECTION 1. That the driveway on Madison Street from the ':lest erty line of 9th street to the East property line of 16th street uding intersection at 13th street in the city of Paducah, ucky, with all necessary manholes, intakes, catch basins, setiier ad drain pipes, and all necessary en_-ineering, advertising and leSall ad clerical services in connection therewith, under an Act of the eneral Assembly of the Commonwealth of Kentucky adopted at its e3ulsr session in 1938, providing for the improvement of public ays in cities of the second class by aid of the ':forks Progress dministration or other agencies of the Federal or State government, nd at the exclusive cost of the owners of real estate abutting on uch improvement to be appropriated on such improvement according to he number of front or abuttint, feet, and providing that a tax shall e levied upon said lots or parcels of real estate for the payment �I f the cost assessed thereon, and which cost shall be the difference atween the total cont of- comnletin� said improvement and the total 4 amount of the contribution of the :7orks Progress Administration or other agencies of the Federal or State Government engaged in making said improvement, and which tax shall be due and payable at the office of the City Treasurer one-half thereof when the work of construction be, -,ins and the remainder thereof when oneohalf of said improvement has been completed, which time shall be determined by the Board of CorrLmissioncrs of said City wr th the advise of the Cit;, En'--in':er, be and the same is hereby ordered to be so constructed and reconstructed with concrete or other improved paving material under the provisions of said laws aforesaid. SECTION 2. That all the cost incident to said construction of said street as provided in Section 1 hereof, except that part which shalt be paid by the Federal or State Government shall be paid for wholly by the property owners of property abutting or fronting upon such improvement on both sides of said street, and to be approtioned to and assessed against said abutting property as provided in Section 1 hereof. SECTION 3. Vlhen said work has been commenced, the Board of Com- missioners with the advice of the city engineer shall cause to be given to the owners of said property abutting upon such improtement so proposed to be made, a notice by the publication of an ordinance or resoluti^on that said work has commenced, and upon the publicat- ion of such resolution or ordinance the owners of such abutting property shall immediately par to tine City Treasurer the amount of one-half of the estimated cost of such improvement as may be apportioned to said respective lots so abutting thereupon, and when said work has been half completed said Board of Commissioners shall likewise publish a resolution or ordinance giving notice of the half completion thereof, and requiring the owners of the abutting property thereon to nay into the city treasury the other one-half of said cost of said improvement so to be assessed against said property and apportioned thereto as aforesaid, and chic h payments shall be made immediately upon the publication of such notices as herein proviced. SECTION 4.
