A RESOLUTION PROVIDING FOR THE CONSTRUCTION AND RECONSTRUCTION
OF THE DRIVEWAY ON NORTH 12TH STREET FROM THE NORTH PROPERTY LINE OF
MADISON STREET TO THE EAST PROPERTY LINE OF PALM STREET, EXCLUDING
INTERSECTIONS AT HARRISON STREET, CLAY STREET, PARK AVENUE, BURNHEIM
AVENUE AND THAT PORTION ALREADY PAVED BETWEEN PARK AVENUE AND BURNHEIM
AVENUE IN THE CITY OF PADUCAH, MCCRAKKEN COUNTY, KENTUCKY, WITH ALL.
NECESSARY CURBS, GUTTERS, DRIVEWAYS, MANHOLES, INTAKES, CATCH BASINS
SEWER AND DRAIN PIPES, AND ALL NECESSARY ENGINEERING, EQUIPMENT,
ADVERTISING AND LEGAL AND CLERICAL SERVICES IPJ CONNECTION THEREWITH,
AS PROVIDED BY LAW, AND VATH THE AID OF THE VIORK PROJECTS ADMINIS-
TRATION OR OTHER AGENCIES OF THE FEDERAL OR STATE GOVERNMENT AND
AT THE EXCLUSIVE COST OF THE OWNERS OF REAL ESTATE ABUTTING ON SAID
STREET, SUCH IMPROVEMENT TO BE APPORTIONED AMONG AND ASSESSED UPON
THE LOTS OR PARCELS OF REAL ESTATE ABUTTING ON SUCH IMPROVEMENT
ACCORDING TO THE NUMBER OF FRONT OR ABUTTING FEET, AND PROVIDING
THAT A TAY. SHALL BE LEVIED UPON SAID LOTS OR PARCELS OF REAL ESTATE
FOR THE PAYMENT OF THE COST ASSESSED THEREON, AND WHICH COST SHALL
BE THE DIFFERENCE BETWEEN THE TOTAL COST DF COMPLETING SAID IMPROVE-
MENT AND THE TOTAL AI„OUNT OF THE CONTRIBUTION OF SAID FEDERAL OR
STATE AGENCIES ENGAGED IN MAKING SAID IMPROVEMENT, AND Vii ICH TAX
SHALL BE DUE AND PAYABLE AT THE OFFICE OF THE CITY TREASURER, ONE-
HALF THEREOF WHEN THE RO RK OF CONSTRUCTION BEGINS AND THE REMAINDER
THEREOF WHEN ONE-HALF OF SAID IMPROVEMENTS SHALL HAVE BEEN COMPLETED
WHICH TIME SHALL BE DETER14INED BY THE BOARD OF COMMISSIONERS OF
SAID CITY WITH THE ADVICE OF THE CITY ENGINEER
WHEREAS, it is deemed and is hereby declared to be a necessity
that the driveway on North 12th Street from the North property line of
Madison Street to the East property line of Palm Street, excluding
intersections at Harrison Street, Clay Street, Park Avenue, Burnheim
Avenue, and that portion already paved between Park Avenue and
Burnheim Avenue, in the City of Paducah, Kentucky, be constructed
and reconstructed of improved paving material under the provisions
of law applicable to cities of the second class, -NOW, THEREFORE
BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY
OF PADUCAH, KENTUCKY:
SEC TI ON 1.
That the driveway on North 12th Street from the North
property line of Madison Street to the East property line of Palm
Street, excluding intersections at Harrison Street, Clay Street,
Park Avenue, Burnheim Avenue and that portion already paved between
Park Avenue and Burnheim Avenue in the City of Paducah, Kentucky, be
constructed and reconstructed of a concrete or such other improved
paving material as may be approved by the Board of Commissioners ofl
the City of Paducah, with all necessary curbs, gutters, driveways,

manholes, intakes, catch basins, sewer and drain pipes and all nec-
essary engineering, equipment, advertising and legal and clerical
services in connection therewith, and all to be done under and pursuant
to statute authorizing such improvements, and pursuant thereto that
said improvement of such public way shall be made by the work
Projects Administration or other agencies of the Federal or State
Government at the exclusive cost of the owners of real estate
abutting on said improvement to be apportioned among and assessed
upon the lots or parcels of real estate abutting on such improvement
according to the number of front or abutting feet, and a tax shall
be levied upon said lots and parcels of real estate for the payment
of the cost assessed thereon, which cost shall be the difference
between the total cost of completing said improvement and the total
amount of the contribution of said Federal or State agencies engaged
in making said improvements, and which tax shall be due and payable
at the office of the City Treasurer, one-half thereof when the work
of construction beging anf the remainder thereof or one-hald of
said cost when one-half of said improvement shall have been completed,
and which time shall be determined by the Board of Commissioners of
it
said city with the advice of the City Engineer, and no property shall
be exempt from such improvement tax, provided, however, that any
assessment for any such improvement as provided for herein which
exceeds one-half of the value of the lots or parcels of real estate
upon which the assessment is made shall be void as to such excess,
ibut the improvements shall be taken into consideration in fixing
the value of such real estate, and the Board of Commissioners shall
provide for the payment of any such excess, if any, out of the
general funds.

SECTION 2.
This Resolution, after its adoption shall be published
in at least one (1) issue of the official newspaper of the
City of Paducah at least seven (7) days before any ordinance
ordering said improvement shall have its final passage.
SECTION 3.
This Resolution shall be in full force and effect from
and after its adoption by the Board of Commissioners and upon
its publication as herein provided.
