A RESOLUTION PROVIDING FOR THE CONSTRUCTION AND RECON-
STRUCTION OF THE DRIVEWAY ON 9TH STREET FROM THE SOUTH PROPERTY LINE
OF KENTUCKY AVENUE TO THE SOUTH PROPERTY LINE OF ADAMS STREET,
EXCLUDING INTERSECTION AT CLARK STREET IN THE CITY OF PADUCAH,
MCCRACKEN COUNTY, KENTUCKY, 'i,'ITH ALL NECESSARY CURBS, GUTTERS,
DRIVEWAYS, MANHOLES, INTAKES, CATCH BASINS, SEWER AND DRAIN PIPES,
AND ALL NECESSARY ENGINEERING, EQUIPMENT, ADVERTISING AND LEGAL AND
CLERICAL SERVICES IN CONNECTION THER MI'ITH, AS PROVIDED BY LAW, AND
WITH THE AID OF THE YIORK PROJECTS ADMINISTRATION OR OTHER AGENCIES
OF THE FEDERAL OR STATE GOVERNMENT AND AT THE EXCLUSIVE COST OF THE
OWNERS OF REAL ESTATE ABUTTING ON SAID STREET, SUCH IMPROVEMENT TO
BE APPORTIONED AMONG AND ASSESSED UPON THE LOTS OR HA RCELS OF REAL
ESTATE ABUTTING ON SUCH I1-IFROVEMENT ACCORDING TO THE NUMBER OF FRONT
OR ABUTTING FEET, AND PROVIDING THAT A TAX SHALL BE LEVIED UPON SAID
LOTS OR PARCELS OF REAL ESTATE FOR THE PAYMENT OF THE COST ASSESSED
THEREON, AND l,"IHICH COST SHALL BE THE DIFFERENCE J3ETVJEEN THE TOTAL
COST OF COMPLETING SAID IMPROVEMENT AND TFIE TOTAL AMOUNT OF THE
CONTRIBUTION OF SAID FEDERAL OR STATE AGENCIES ENGAGED IN MAKING SAID
IMPRW EMENT, AND WHICH TAX SHALL BE DUE AND PAYABLE AT THE OFFICE OF
THE CITY TREASURER, ONE-IIALF THEREOF WHEN THE WORK OF CONSTRUCTION
BEGINS AND THE REMAINDER THEREOF WHEN ONE-HALF OF SAID IMPROVEMENTS
SHALL HAVE BEEN COMPLETED, WHICH TIME SHALL BE DETERMINED BY THE
BOARD OF COMMISSIONERS OF SAID CITY WITH THE ADVICE OF THE CITY
ENGINEER
WHEREAS, it is deemed and is hereby declared to be a
necessity that the driveway on 9th Street from the South property
line of Kentucky Avenue to the South property line of Adams Street,
excluding intersection at Clark Street in the City of Paducah,
Kentucky, be constructed and reconstructed of improved pabing
material under the provisions of law applicable to cities of the
second class,- NOW THEREFORE,
BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY
OF PADUCAH, KENTUCKY:
SECTION 1.
That the driveway on 9th Street from the south property line
of Kentucky Avenue to the South property line of Adams Street, ex-
cluding the intersection at Clark Street in the City of Paducah,
Kentucky, be constructed and reconstructed of a concrete or such
other improved paving material as may be approved by the Board of
Commissioners of the City of Paducah, with all necessary curbs,
gutters, driveways, manholes, intakes, catch basins, sewer and drain
pipes and all necessary engineering, equipment, advertising and legal
and clerical services in connection therewith, and all to be done
under and pursuant to statute authorizing such improvements, and

Pursuant thereto that said improvement of such public way shall be

made by the Work Projects Administration or other agencies of the
Federal or State Government at the exclusive cost of the owners of

l real estate abutting on said improvement to be apportioned among and Wr

II assessed upon the lots or parcels of real estate abutting on such

improvement according to the number of front or abutting feet, and
�I a tax shall be levied upon said lots and parcels of real estate for

the payment of the cost assessed thereon, which cost shall be the
it difference between the total cost of completing said improvement
and the total amount of the contribution of said Federal or State
Agencies engaged in making said improvements, and which tax shall
jbe due and payable at the office of the City Treasurer, one-half t
thereof when the work of construction begins and the remainder
IIthereof or one-half of said improvement shall have been completed
and which time shall be determined by the Board of Commissioners of
said city with the advice of the City Engineer, and no property
shall be exempt from such improvement tax, provided, however, that
any assessment for any such improvements as provided for herein
II which exceeds one-half of the value of the lots mr parcels of real
estate upon which the assessment is made shall be void as to such
excess, but the improvements shall be taken into consideration in
fixing the value of such real estate, and the Board of Commissioners

shall provide for the payment of any such excess, if any, out of the
general funds.
SECTION 2.
This Resolution, after its adoption shall be published
in at least one (1) issue of the official newspaper of the City
of Paducah at least seven (7) days before any ordinance ordering
said improvement shall have its final passage.
SECTION 3.
This Resolution shall be in full force and effect from
and after its adoption by the Board of Commissioners and upon
its publication as herein provided.
