'SiHEREAS, on.the 2nd_ day of September, 1941, the Board
o_" Commissioners of the City of Paducah received and filed a
petition requestin; the adoption of an ordinance entitled:

"'HEREAS, under a resolution adopted within ten
(10) days after said petition ::a.s filed, the Board of Commissioners,
IIdeclined to submit to the voters at the next regular election
the question of the passage of said ordinance; and,

I' ',7KEREAS, Ellis Rives and others as ;plaintiffs
thereafter instituted in the "r,:cCracken Circuit Court a mandamus
proceedin., to require the members of the board of commissioners
to certify to the voters the question as to the passa-e of said
ordinance, and upon the appeal from the judgment of the circuit
Court denying to the plaintiffs the relief sou.ht, the Court
of appeals reversed •the judgrpent of the Lover Court and issued
a mandate orderin; and directin_, the lover court to enter a
judgment consistent with its opinion; and
VmEttEAS, under a judgment of the ,�,cCracken Circuit
Court rendered upon the mandate issued by the Court of Appeals,
the Board of Commissioners have been ordered and directed to
at once certify and submit the question of the passage of
said ordinance to the voters of the City at the next regular
election to be held on November 4th, 1941;
NMN, THEREFORE, BE IT ORDAINED BY THE 3OARD

SECTIOlI 1.
That there is submitted to the voters of the City
of Paducah, Kentucky, at the next reular election to be held
ins aid city on November 4Lh, 1941, the question of the

passage of the aforesaid ordinance, which ordinance was proposed
by petition and was not adopted by the Board of Commissioners
within ten days after the filing of said pet; tion, and the
question to be printed upon the ballot at said election shall
be as follows:
"QUESTION: Shall the proposed Ordinance be passed, entitled,

BE it ordained by the Board of Commissioners
of the City of Paducah, Kentucky, gnat from
and after the effective date of this Ordinance,

Section 1: There sha11 be kept and continued
jin the employ and service of the City of
Paducah, Kentucky ,just as is now being done,
the follo:^rin7 ranking em�)loyees in the Police
Department, to -wit:
One Chief of Police
One Chief-etective
One Assistant :%hief of Police
Three Captains
One Lieutenant
One Sar,ent
T,;enty-five Privates
One Chief Radio Operator
And in the Fire Department of the City of Paducah,
�I Kentucky there shall be:
One Chief of Fire Luepartment
One Assistant Chief of Fire Department
Six Captains
Six Lieutenants
One Chief ;..echanic
TWenty Privates
Three Operators of Switch Board, who shall
be in addition to the 'iWenty Privates
SECTIO:,' II: That each and eery employee aforesaid o
the rank and station designated herein, who has serve
one year or more in the Police Department or Fire de-
partment of the City of Paducah, Kentucky, not noir al
ready being paid and receiving from the City of Paduc
Kentucky a monthly wage of as much as One Hundred and
Fifty (V150) Dollars per month shall be paid by the C
of Paducah, Kentucky for their servicea a minimum u,a,
of One Hundred and Fifty (?;150) Dollars per month fro
j and after the effective date of this Ordinance.
SECTION III: Any and all other employees of the City
of Paducah, Kentucky, r;hose rank is not d esi mated or

herein provided for, shall not be affected by the
Ordinance in anysjise whatever.

SECTION IV: All ordinances, parts of Ordinances and
Rules of the City of Paducah, Kentucky, and its Board

of Commissioners now in force and of ect that do,
or may in anywise conflict with this ordinance, or
to the extent of such conflict are herebyrepealed.
SECTION V: If any part of this Ordinance shall for
any reason by adjudged by any court of competent
i
li jurisdiction to be unconstitutional or invalid,
I
�I such judment shall not affect, impair or invalidate
the remainder thereof, but shall be confined in its
operation tos uch part of this Ordinance asmay be
i
directly involved in controversy in which said judgment
shall have been rendered.
SECTION VI: This ordinance shall take effect
from a:d after its passa,e, recordation and publication
as provided and required by law.
Those in favor of:the passage of said Ordinance
shall vote Yes; those op,osed shall vote No.

Said question when printed upon the ballot and
voted upon shall be certified by the Election ^o:7imissioners as
any other public question, and theVotes thereon certified to

the Doard of Corimi:sioners and spread upon the record of this
Board, and said ordinance after said adoption by.a majority

of the votes cast on said question, shall become effective as
j soon as the result thereon is officially ascertained and declared!
I
by said Board of Election Commissioners.
i
The question of the adoption of said ordinance
as the same shall be printed upon the ballot shall be advertised
I
in the official newspaper of the Uity of Paducah by the publication
in full of said question not less than ten (10) nor more than
fifteen (15) days before the date of said General Election.

SECTIC?, 4.
This ordinance shall be in full force and effect from and
after its adoption.
