'.,'HEREAS, on the 30th day of September, 1941, the Board of
Co;nmissioners of the City of Paducah, received and Paled a petition
requesting the adoption of an ordinance entitled: "Aid ORDINANCE
CREATING A CIVIL SERVICE SVS10., PURSUAbiP TO THE PROVISIONS CF
CHAPTER 53 OF THE ACTS OF THE GENERAL ASSEMBLY OF KENTUCKY, 193E
REGULAR SESSION, BEING NOW SECTIONS 3235h-1 to 3235h-12, INCLUSIVE
BALDYiIiN'S 1939 SUPPLEIENT TO THE KENTUCKY STAPUTES, FOR 1'1IE CITY OF
PADUCAH, KENTUCKY, AND FOR THE LWPLOYEES THEREPF; PROVIDING ?On TIE
PLACING OF ALL EMPLOYEES OF THE CITY OF BIDUCAH UNDER CIVIL SERVICE
EXCEPT THE MEMBERS OF THE POLICE AND FIRE DEPART:.TENTS, 'fdE EI,PLOUEE

WHEREAS, it appearing that the petitions contained the
signatures of 2908 voters of the City of Paducah, Kentucky; and,
It further appearing that at the last preceding regular
election for Vayor there were cast 7596 votes for both candidates,
and that the number of voters who signed said petitions considerably
exceed 25$ of the tital number of votes cast for both candidates
for Eayor at the last preceding regular election for Mayor; and,
'HLaEAS, said petitions set forth the residence of each
signed, and are verified by the affidavits of one or more persons

NOW, 'T`IEREFORE, BE IT ORDAINED BY PHE BOARD OF COIr:.";.ISSIONERS

SECTION III
"That there shall be a pension fund created, in accordance
with the provisions of Section 3235h-10 of the Kentucky Statutes,
for the benefit of the employees of the City of Paducah affected
by this ordinance.
"That the Mayor and City Commissioners shall, within thirty
days after the passage of this ordinance, enact an ordinance
setting up said pension fund, to become effective January lst, 1242;
and appointin; a Board of Trustees for administering said Pension
Fund, designating their powers and duties, and drafting all rules
and regulations necessary for the functioning of same, as provided
in Section 3235h-10 of the Itentucky Statutes.
SECTION IV
"That the various departments of the city government and
the employees thereof affected hereby shall be as are now constituted
under the de>artmental arrangement of the city government under
existing ordinances. In case by subsequent ordinance, or other-
wise, the name or duties of any department be changed or its affiars
be merged with some other department, the civil service rights of
all employees thereof shall not be affected thereby;.' and any
transfer of such duties and powers to another department shall
carry with it the transfer of the employee performing such duties.

"That all ordinances or.parts of ordinances in conflict
with the provisions of this ordinance are hereby revoked and repea

invalid or unconstitutional, such fact shall not affect any other
section of this ordinance, it being the intention of the Board
of Commissioners in enacting this ordinance to enact each section
separately.

"BE IT ORDAINED BY THE BOARD OF COEi.,ISSIONLES OF THE CITY
OF PADUCAH, KENTUCKY.
SECTION 1.
"That all employees of the City of Paducah be and the
same are hereby _placed under Civil Service rules and regulations,
pursuant to and in accordance with the provisions of Sections
3235h-1 to 3235h-12 inclusive of the Kentucky Statutes, except
members of the Police and Fire Deoartr"ents, the employees of the
Riverside ':os-)itsl, the members of the Boards of Park Commissioners,
and the City :,tanager
SECTION II.
"That a Civil Service Commission shall be a.)pointed s
provided for by the provisions of Section 3235h-2 of the Kentucky
Statutes; and that their powers and duties shall be those set up
by, and in accordance with, Section 3235h-3 of the Kentucky
Statutes.
SECTION III

SECTION 2.
That said question be voted upon at the next re_-ular
election in the City of Paducah to be held on the f irst Tuesday
after the first i'.onday :ih November, 1941, and that the question
to be printed upon the ballot shall be as follows:

Said question when printed upon the ballot and voted upon
shall be certified by the `lection Commissioners as any other
public question, and the votes thereon certified to the Board of
Commissioners and spread upon the record of this Board, and said
ordinance after said qdoption by ,z majority of the votes cast
on said question, shall become effective as soon as the result
thereof is officially ascertained and declared by said Board of
Election Commissioners.
SECT.ON 4.
The question of thea doption of said ordinance shall be
advertised in the official newspaper of the City of Paducah by
the publication in full of this ordinance not less than ten (10)
nor more than fifteen (15) days before the date of said General
election.
