A RESOLUTION DECLINING TO SUBMIT TO THE VOTERS OF THE
CITY OF PADUCAH, KENTUCKY, AT THE NEXT REGULAR ELECTION TO BE HELD
ON THE FIRST TUESDAY AFTER THE FIRST MONDAY IN NOVEPSBER, THE QUESTI
OF THE PASSAGE OF AN ORDINANCE ENTITLED: "AN ORDINANCE ESTABLISHIN
THE NUMBER, AND MINIMUM MONTHLY COMPENSATION OR WAGE, OF CITY
EMPLOYEES OF THE POLICE AND FIRE DEPARTMENTS, RESPECTIVELY, OF THE
CITY OF PADUCAH, KENTUCKY", WHICH WAS REQUESTED TO BE PASSED BY THE
I BOARD OF C�-I:T:ISSIONERS OF THE CITY OF YAIIICAH UPON A PETITION FILED
WITH SAID BOARD AT A REGULAR MEETING HELD ON THE 2I1D DAY OF
SEPTEMBER, 1941
WHEREAS, on the 2nd day of September, 1941, the Board
of Commissioners of the pity of Paducah received and filed a
petition requesting the adoption of an ordinance entitled -
MAN ORDINANCE ESTABLISHING THE NLT.IBER, 14ININUI'A MONTHLY COMPENSATION

OR WAGE, OF CITY EMPLOYEES OF THE POLICE AND FIRE LE?ART-14ENTS,
RESPECTIVELY, OF THE CITY OF PADUCAH, KENTUCKY"; and,

WHEREAS, under the Apportionment Ordinance adopted by the
City of Paducah for the year 1941, the total sum of $121,646.44
was appropriated for payment of the expense for operation of the
police and fire departments, including the amount necessary for
payment of salaries to the members of said departments at the rates
fixed under said ordinance, and w hick sum is not sufficient for
payment of salaries at any increased rates; and,
WHEREAS, the ordinance which the petitioners have
requested this Board to pass provides that it would take effect fro:
and after the date of its adoption, and if passed the City of Paduc
will be required to pay the members of the PoliHe and Fire Departme.
salaries at the rate of 5;150.00 per month for the remainder of the
year 1941, and the payment of the additional salaties for the
remainder of the year 1941 will impose upon the city of Paducah an
additional expense of approximately w5,340.00, which sum of $5,340.1
is not included in the aforesaid amount apportioned for the use and
benefit of said departments during said yaar; and,
WHEREAS, under the provisions of Section 3235dd-38 it is
provided that no other liabilities shall be incurred by any officer
or employee of a city, except in accordance with the provisions of
the annual appropriation ordinance; and,
WHEREAS, it is questionable as to whether or not the
matter of fixing salaries of policemen and firemen can legally
be submitted to a vote of the people under the Statutes and
�ConstItution of the State of Kentucky; and,

WHEREAS, under Section 3235dd-47, the Board of
Commissioners has no right to submit the question of the passage
of the aforesaid ordinance to the voters of the City if said
ordinance is nne which the board does not have the legal right
to pass;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1.
That the Board of Commissioners decline to submit to the
voters of the City of Paducah, Kentucky, at the next regular
election to be held on the first Tuesday after the first Monday
in Nolvember in 1941 the question of the passage of an ordinance en-
titled: "All ORDINANCE ESTABLISHING THE NUMBER, AND MINI'UP.?
MONTHLY COI-APLUSATION OR I7AGE, OF CITY EMPLOYEES OF THE POLICE AND
FIRE DEPARTI-!ENTS, RESPECTIV=E, OF 'HiECITY OF PADUCAH, KENTUCKY",

which was requested to be passed by the Board of Commissioners of
the City of Paducah upon a petition filed with said Board at a
Regular Meeting held on the 2nd day of September, 1941.

SECTION 2.
This Resolution shall be in full force and effect f rom
and after its adoption.
