AN ORDINANCE ASSESSING THE ABUTTING PROPERTY ON BOTH SIDES
OF 11TH STREET FROM THE SOUTH PROPERTY LINE OF TENNESSEE STREET TO
THE SOUTH PROPERTY LINE OF CALDWELL STREET IN THE CITY OF PADUCAH,
MCCRACKEN COUNTY, KENTUCKY, FOR THE PORTION OF THE COST OF CONSTRUC-
TION OF SAID STREET AND IMPROVEMENT 'THEREOF, BY THE PLACING THEREIN
AND THEREON OF A CONCRETE SURFACE TOGETHER WITH ALL NECESSARY CURBS,
GUTTERS, DRIVEWAYS, MANHOLES, INTAKES, CATCH BASINS, SEWER AND DRAIN
PIPES AND ALL NECESSARY ENGINEERING, EQUIPMENT, ADVERTISING AND
LEGAL AND CLERICAL SERVICES IN CONNECTION THEREWITH UNDER THE
PROVISIONS OF AN ACT OF THE GENERJRL ASSEMBLY OF THE COMMONWEALTH
OF KENTUCKY ADOPTED AT ITS REGULAR SESSION IN 1938, PROVIDING FOR
THE IMPROVEMENT OF PUBLIC WAYS IN CITIES OF THE SECOND CLASS BY AID
OF THE WORI{ PROJECTS ADMINISTRATION OR OTHER AGENCIES OF THE
FEDERAL OR STATE GOVERNMENT, AND AT THE EXCLUSIVE COST OF THE
OWNERS OF REAL ESTATE ABUTTING ON SUCH IMPROVEMENT ACCORDING TO THE
NUMBER OF FRONT OR ABUTTING FEET, AND PROVIDING THAT A TAX SHALL
BE LEVIED UPON SAID LOTS OR PARCELS OF REAL ESTATE FOR THE PAYMENT
OF THE COST ASSESSED THEREON, WHICH COST SHALL BE THE DIFFERENCE BETWEEN
THE TOTAL COST OF COMPLETING SAID IMPROVEMENT AND THE TOTAL AMOUNT
OF THE CONTRIBUTION OF THE WORIt PROJECTS ADMINISTRATION OR OTHER
AGENCIES OF THE FEDERAL OR STATE GOVERNMENT ENGAGED IN MAKING SAID
IMPROVEMENT, AND WHICH TAX SHALL BE DUE AND PAYABLE AT THE OFFICE
OF THE CI'YY TREASURER IN THE CITY HALL IN PADUCAH, ONE-HALF
THEREOF WHEN THE VO RK OF CONSTRUCTION BEGINS AND THE REMAINDER
THEREOF WHEN ONE-HALF OF SAID IMPROVEMENTS SHALL HAVE BEEN COMPLETED,
WHICH TIME SHALL BE DETERMINED BY THE BOARD OF COMMISSIONERS WITH .
THE ADVICE OF THE CITY ENGINEER; AND ALL THE ENGINEERING WORK HAVING
BEEN COMPLETED AND THE ESTIMATED COST ASCERTAINED, AND IT BEING
DETERMINED FROM SAID ESTIMATES AFTER DEDUCTING THE AMOUNT TO BE
CONTRIBUTED BY THE WORK PROJECTS ADMINIS TRAGION OF THE UNITED STATES
THAT THE AMOUNT REQUIRED TO BE CONTRIBUTED BY THE ABUTTING PROPER TY
OWNERS ON 11TH STREET SHALL BE $1.70 PER FRONT FOOT FOR STREET PAVING;
ALL DRIVEWAYS TO BE $0.12 PER SQUARE FOOT, ALL CURBS TO BE $0.30 PER
,LINEAR FOOT, ALL GUTTERS TO BE $0.20 PER LINEAR FOOT: AND THE CITY
OF PADUCAH BEING NOW READY TO COMMENCE WORK ON SAID IMPROVEMENT AS
OF THE DATE OF THE ADOPTION OF THIS OHI% NANCE
WHEREAS, the Board of Commissioners has heretofore
adopted an ordinance providing for the construction and reconstruction
of said dtiveway under the terms of said Act aforesaid, and pursuant 1s
to its provisions; and,

WHEREAS, work is now ready to begin on said construction j
' land one-half of the estimated cost thereof is now due to be paid tol
the City Treasurer,

OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1.
That all of the property on both sides of 11th Street from
the South property line of Tennessee Street to the South property
line of Caldwell Street in the City of Paducah, Kentucky, as shown
Iby estimates on file in the EnZineers+ Office in the City Hall in
the City of Paducah, Kentucky, be and the same is hereby assessed
;for the cost of construction of said paved street with all necessary
,curbs, gutters, driveways, manholes, intakes, catch basins, sewer

Band drain pipes and all necessary engineering, equipment advertise -,i

!ment and legal and clerical services in connection therewith, the
I
portion of said cost of improvement reauired to be paid by said
,property owners shall be the following amounts, to -crit:
On 11th Street between Tennessee Street and Caldwell Street
for street paving 1, }1.70 per front foot; all driveways to be X0.12

per square foot, all curbs to be x;0.30 per linear foot, all gutters
,to be $0.20 per linear foot; that all of said estimates are on file
in the office of the Engineering Department in the City Hall, and
are referred to and made a part hereof.
SECTION 2.
That one-half of said assessment as against each lot as shown
by said assessment and estimate of said engineer is now due and
unless paid within ten (10) days after the adoption of this
,ordinance there shall be added thereto a penalty of 6% and a lien
is declared to exist upon said lots and parcels of real estate for
the portion of cost of said improvement ao assessed as herein
provided, and the amount of said assessment shall bear interest
,upon any part thereof that remains unpaid for ten (10 ) days after)
same is due to be paid at the:irate of 6;� per annum in addition to
the penalties aforesaid, vhich lien shall be superior to all other
Aliens except the lien for State, County and City Taxes. i
SECTION 3.
The publication of this ordinance shall be notice to all
persons interested and due to pay said assessment, of the time and
place to pay the same. Said assessment will be paid one-half within

ten (10) days from the publication of this ordinance, and the other
I
lone -half will be paid when the Board of Commissioners shall declare,
I
by ordinance or resoclution,t hat said work and said improvement has
been izld one-half completed.

SECTION 4.
This ordinance shall be in full force and effect from
and after its adoption.
